Part 2 established that AI training creates prima facie copyright liability under US law. The question every general counsel asks next is the obvious one: is there a defense? In the United States, the principal defense is fair use. Codified in 17 U.S.C. § 107, it is not a blanket permission. It is a case-by-case defense, evaluated after the fact, with no single factor dispositive. AI companies have placed enormous weight on it, arguing that training is “transformative” and therefore excused.
