Private markets play an increasingly important role in capital formation, business expansion, and job creation, but access to those investment opportunities remains limited for most retail investors.

On June 11, 2026, the US Supreme Court held that Section 47(b) of the Investment Company Act (ICA) does not create a private right of action for shareholders to sue ICA registered funds for recission. The ruling in FS Credit Opportunities Corp. v. Saba Capital Master Fund, Ltd. is a significant victory for the registered fund industry.

As private markets have grown, increased ability for retail investors to access diversification opportunities has become an industry focus. Although access to private equity, private credit, infrastructure, and real estate has long been limited to institutional and ultra-high-net-worth investors, regulatory barriers to alternative assets are softening.
