News: USCIS Issues Guidance on Making Public Charge Inadmissibility Determination
U.S. Citizenship and Immigration Services (USCIS) is issuing updated guidance in the USCIS Policy Manual explaining how the agency will determine whether an alien applying for adjustment of status to that of a lawful permanent resident is likely at any time to become a public charge. On July 16, 2026, DHS announced a final rule that rescinds the 2022 Biden-era public charge inadmissibility regulations.
The Time to Pay the Asylum Fee Is Now
Last year, theOne Big Beautiful Bill created a filing fee for asylum and an annual fee that asylum seekers must pay each year their application is pending. Unfortunately, the roll out of the fee payment system was a mess. It was impossible to pay the fee unless you first received a notice from USCIS or EOIR (the Executive Office for Immigration Review--the office that oversees our nation's Immigration Courts), but some people were able to pay without receiving a notice.

USCIS Publishes New Editions of Forms I-539 & I-765; Older Editions Will Be Rejected Starting September 15
USCIS will publish revised editions of Form I-539, Application to Extend/Change Nonimmigrant Status, and Form I-765, Application for Employment Authorization on September 15. The revised forms implement the recently published final rule ending the long-standing Duration of Status admission framework for F-1 students, J-1 exchange visitors, and representatives of foreign media. Individuals in these statuses will be required to file the I-539 to extend their period of authorized stay moving forward.

The Future of Asylum at the Southern Border: An Overview of the U.S. Supreme Court Decision by Kalei Scully On June 25, 2026, the Supreme Court decided that a foreign national standing in Mexico does not "arriv[e] in the United States" if he is "at" the border to the U.S. but does not set foot in this country.[i] An alien "arrives in the United States" only when he crosses the border.[ii] This case has important implications for asylum seekers at the Southern border.
