Appeal Court Voids Electoral Act Provisions on Party Primaries, Membership Registers
The Court of Appeal in Abuja has declared unconstitutional key provisions of the Electoral Act 2026 that restricted political parties to conducting direct primaries or adopting consensus in selecting candidates for elective offices. In a unanimous judgment delivered on Thursday, a three-member panel led by Justice Balkisu Aliyu also invalidated Sections 77(5), 77(6), and 77(7) of the Act, ruling that they amounted to unconstitutional interference in the internal affairs of political parties.
