Gibraltar is well known for being nimble and its track record remains unchanged when it comes to prediction markets. In this area, rather than subjecting entrepreneurs to bureaucratic delay while a new regulatory branch was established, Gibraltar instead licensed a prediction market operator under the existing gambling framework.

HM Government of Gibraltar has now published the Protected Cell Companies (Amendment) Bill 2026, introducing a legal framework for tokenised shares within protected cell companies authorised as experienced investor funds. The aim of the Bill is to recognise tokenised shares, DLT share registers, and align them with the current recognition of share certificates under Gibraltar law.

Gibraltar has tightened regulatory oversight of EMI, DLT providers and VAA Providers through the Financial Services (E‑Money Firms and DLT Providers etc.) (Amendment) Regulations 2026. The new regime introduces a mandatory GFSC clearance process before any dividend or other capital distribution can be made.

Deadline Notice : Small and External AIFM (including Private Funds) Appointment of Local Administrators and Appropriate Persons in respect of Safe Custody of Assets – 8 May 2026. Under the Financial Services (Alternative Investment Fund Managers) (Amendment) Regulations 2025 (the “AIFM Amendment Regs”) published on 8 May 2025, self-managed and external AIFMs are required to comply with new rules. These amendments, in practice, apply to Gibraltar private funds.

As outlined in the Financial Services (Core Principles and Consumer Duty) Regulations 2024, the framework allows for the extension of Gibraltar’s Consumer Duty to cover all retail customers—both UK and non-UK—of Gibraltar financial service providers. This extension would occur on a date appointed by the Minister. During the rollout of the regime in 2024, it was suggested that early to mid-2026 might be a potential timeframe for such an extension.

On 27th October 2025, Gibraltar will implement amendments to its financial regulatory framework. These changes primarily focus on the regulation of virtual asset arrangements (VAAs) (also known as Virtual Asset Service Providers/VASPs), reflecting Gibraltar’s evolving approach to digital finance and distributed ledger technologies (“DLT”). Previously, VAAs only required a registration pursuant to the Proceeds of Crime Act 2015 (Relevant Financial Business) (Registration) Regulations 2021.

The Government of Gibraltar has published (6th October 2025)  Legal Notice No. 246 of 2025 under the provisions of the European Union (Withdrawal) Act 2019 regulations which aim to mitigate the unprecedented influx of EEA nationals seeking residence in Gibraltar. The provisions in section 55NA are temporary and will cease upon an Order by the Chief Minister. Provision is made for issuing residence documents in limited circumstances.
