English Directive (EU) 2022/2464 (CSRD) transformed the level of engagement and due diligence that companies must exercise regarding their sustainability information— environmental, social, and governance (ESG)—shifting from voluntary disclosure to a legal obligation integrated into the management report. This study examines whether Article 290 of the Spanish Criminal Code provides an adequate criminal response to the falsification of non-financial information statements (EINF).
El método del caso como solución frente a la enseñanza excesivamente dogmática del Derecho penal
English In this paper, we advocate the implementation of the case method as a solution to the excessively dogmatic teaching of criminal law. We begin by noting students’ lack of interest, low class participation, and deficiencies in oral and practical skills caused by the lecture method, and propose the implementation of the case method in four phases (preliminary, gathering opinions, comparison, and theoretical reflection).
