Parental Responsibility - What can be done if you disagree?
What is Parental Responsibility? What can be done if you disagree? These are questions often asked of family lawyers. Although the concept of “parental responsibility” has been around since the Children Act commenced in 1991 it is helpful to give some examples of the decisions that are made regarding children that are included by it.
Child at home under care or supervision order?
The Court of Appeal recently considered the principles in making a decision whether a child should be at home under a final supervision or care order. The court noted there seemed to be different approaches taken in different parts of the country but there needed to be a common approach.
Supervision Order reform
One of the options available to the Court within children public law care proceedings is a supervision order, initially for 1 year, but potentially extendable. Their purpose is to advise, assist and befriend the child who has suffered and/or at risk of suffering significant harm due to their parents care. There have been concerns about the effectiveness of such orders in safeguarding children. A review of supervision orders was published in April 2023.
Permission to appeal
Often following the outcome of family proceedings one or may be more of the parties may consider that a decision that has gone against them should be appealed. However, it is not simply a case of a disagreement with a court’s decision leading to an automatic right to appeal that decision. There is a process that has to be followed with strict legal tests. What if I wish to appeal the decision? The starting point is to seek permission to appeal from the Judge who gave the disputed decision.
