Congress Must Resolve PSLRA Issue For Section 11 Litigants
Uncertainty in Section 11 securities litigation has grown following the Supreme Court’s Slack v. Pirani decision and ambiguities in the Private Securities Litigation Reform Act (PSLRA). The PSLRA grants judgment reduction credits when outside directors settle, but its silence on other Section 11 defendants has created confusion that discourages fair and efficient settlements.

Between Now and Future Sovereignty: Indigenous Forestry in the Conjuncture
Introduction In the spring and summer of 2021, thousands of forest defenders descended upon the unceded territories of the Pacheedaht1 nation on the southwest coast of Vancouver Island, British Columbia (BC) to defend a remote watershed known as Ada'itsx/Fairy Creek from the imminent threat of industrial logging.2 Hailed as a “last stand” for the ancient forest, the blockade actions at Ada'itsx resulted in the largest mass arrests in Canadian history.3 However, claims by forest defenders that...

by Bruce Braun “Practice puts brains in your muscles.” Sam Snead. The competition has begun. Round one of our league championship is in the books. So, how did everyone do with having to putt out and not having any gimmees? Our group was a bit forgetful at first! Not enough to be problematic but it was evident however, that even 12-inch putts can get your attention! 57 league members began their quest for the coveted trophies. An additional 3 guests came along to watch the drama unfold.

by Bruce Braun “Golf is an awkward set of bodily contortions designed to produce a graceful result.” – Tommy Armour It’s been quite a while since we’ve had such a cool morning. I suppose it’s an omen for what is to come. It did warm up nicely, however, and there were some great shots to be had. 57 members and 3 guests made the rounds today.

by Bruce Braun “Golf is the only game I know of that actually gets harder the longer you play it.” Bobby Jones. Another beautiful and warm day with a slight breeze out of the south. 59 members and 5 guests did their best. This week’s scramble was on the back nine leaving the front nine for golfers to record their stroke play scores. It is fair to say that the front nine is the more difficult nine on the golf course.

by Bruce Braun “You know what they say about big hitters: the woods are full of them.” Jimmy Demaret. Another lovely day! Barely a lick of wind and temperatures that made a few of us men melt. 62 men and 5 guests made up today’s roster. Numerous terrific scores were recorded. There were several eagles on the scramble half of the scorecard today but none as spectacular as that of Doug Gann on the 11th hole, on his own ball, where he dropped his approach shot from about 150 yards for a 2.

by Bruce Braun “The mind messes up more shots than the body.” –Tommy Bolt As I typically do, when I get up in the morning, I do a quick scan of the skyline and then focus my bleary eyes on the outdoor thermometer. +9°C. I don’t recall having those temperatures in quite some time. Are the dog days of summer behind us? Our house windows had a glaze of fog on them and the spiderwebs on the railing outside were outlined in dew.

by Bruce Braun We couldn’t have had a more brilliant, or possibly warmer, day for the final leg of the Kenora versus Beauty Bay senior men’s leagues. A total of 91 golfers were in attendance: 64 BB members, 17 Kenora members, and 10 guests. Before I provide you with the results, I must let you know that I stand corrected on a previous incorrect report. I had indicated that the competition between the BB senior men’s league and the Kenora senior men’s league would be low net score.

by Bruce Braun “Sometimes the biggest problem is in your head. You’ve got to believe.” -Jack Nicklaus. Just before teeing off this morning 60 members and 2 guests gathered on a hilltop, otherwise known as the ninth tee. The elevated location looks south over Upper Black Sturgeon Lake. It is a fitting location to offer some repose as we gathered to pay our respects to former Beauty Bay senior league members that have moved on and have joined another club.
Beauty Bay Golf Course, Senior Men’s League, July 16, 2024
by Bruce Braun “Success depends almost entirely on how effectively you learn to manage the game’s two ultimate adversaries: the course and yourself.” Jack Nicklaus. Recent storm clouds have passed through in time for a beautiful day today, albeit a bit cooler. Today 64 members and 5 guests enjoyed what Beauty Bay has to offer. Tomorrow, the Kenora senior men’s league hosts the BB senior men’s in the first of a two-part battle.

by Bruce Braun “Golf is a game of inches. The most important are the six inches between your ears.” Arnold Palmer. It was a picture-perfect day at Beauty Bay Golf Course. This would be our ninth Tuesday since the season began, but only our fifth time golfing as we have had such a wet run of weather. It was very nice to see so many smiling and squinting faces! A big kudos to all of you men who have contributed to this weekly newsletter with your pictures and anecdotes.

by Bruce Braun “Of all the hazards, fear is the worst.” Sam Snead. Well folks, it happened again. Another canceled Tuesday senior men’s league golf. Check between your toes for any early-stage webbing and tendencies to quack. Today was supposed to be the memorial service. This will be postponed to another date. We will keep you posted. Next week, July 9, will be our annual barbecue. Please plan to stay around after your game and enjoy what the chefs have to offer.

by Bruce Braun “It’s a funny thing – the more I practice, the luckier I get.” – Arnold Palmer. After a three-week hiatus from golf due to all that wet weather there sure were a lot of smiles as Beauty Bay Senior Men’s League returned to the golf course. A big hip hip hooray! 73 members and 3 guests participated today. Next week we will be gathering on the ninth tee hilltop for our annual memorial service. From there, you will be heading to your designated start hole.
Beauty Bay Golf Course, Senior Men’s League, June 18, 2024
by Bruce Braun “The only thing a golfer needs is more daylight.” – Ben Hogan (and I would like to add… less rain”). Well, for the third Tuesday in a row, our BB senior men’s league has been canceled due to the weather. I recall earlier this spring when folks were concerned about the lack of snow this winter and how that might translate to a more severe fire season. A legitimate concern that I would suggest has been somehow washed away for the time being.
Beauty Bay Golf Course, Senior Men’s League, June 4, 2024
by Bruce Braun “A shot that goes in the cup is pure luck, but a shot to within two feet of the flag is skill.” Ben Hogan. Well, I can’t say I was surprised when I saw that plans for today’s senior men’s league were canceled. May was a wet month and June hasn’t really impressed yet.

by Bruce Braun “The sole purpose of the golf swing is to create a correct IMPACT. How that is done is of no consequence as long as a method employed allows you to REPEAT it!!” John Jacobs. Holy guacamole… have we ever had a wet and cool week. BB has been closed for much of the past week due to the unrelenting cool and rainy days. Just when most of us are ready to get some rounds of golf in we are stuck at home, looking out the window with our lower lip quivering.

By Bruce Braun “In golf, you can hit a two-acre fairway ten percent of the time, but hit a two-inch branch ninety percent of the time.” Submitted by Dennis O’Sullivan The misery and the joys. Another wonderful day at Beauty Bay Golf Course! A total of 64 golfers participated and everybody, and I mean everybody, had at least one good shot. At least I am convinced of that! Somehow you would think that’s what it takes to keep us coming back. But it’s not true.
Beauty Bay Golf Course, Senior Men’s League, May 14, 202
By Bruce Braun “A perfectly straight shot with a big club is a fluke.” Jack Nicklaus Our first league play of the season was a smashing success! A total of 67 men arrived for our league opening day. Lots of laughs, plenty of smiles and a few nice shots! I hope everybody had as good a time as our group did? I try to remember to share three rules with my group before starting our round… Rule number one; have a good time. Rule number two; win.
Beauty Bay Senior Men’s League begins soon
Beauty Bay Golf Course, Senior Men’s League, Season Opener, 2024 by Bruce Braun “Golf is deceptively simple and endlessly complicated; it satisfies the soul and frustrates the intellect. It is at the same time rewarding and maddening – and it is without a doubt the greatest game mankind has ever invented.” – Arnold Palmer. So here it is folks. Spring! Hooray! The days are getting longer, which means you probably woke up one morning not too long ago and the sun was blinding you.
Beauty Bay Golf Course, Senior Men’s League, September 5, 2023
by Bruce Braun “I'm working as hard I can to get my life and my cash to run out at the same time. If I can just die after lunch Tuesday, everything would be perfect.” – Doug Sanders, PGA Tour. I am gobsmacked! The forecast for today was dismal.
Beauty Bay Golf Course, Senior Men’s League, August 29, 2023
by Bruce Braun Once asked what was the secret to longevity and good golf Nick Price, former PGA professional spending 43 weeks at number one in the OWGR, gave the following answer: “Spend more time with the people who make you laugh, and always have something to look forward to.” The competition has begun. 72 league members began their quest for the coveted trophies. An additional 4 guests came along to watch the drama unfold.
Beauty Bay Golf Course, Senior Men’s League, August 22, 2023
By Bruce Braun “The only time my prayers are never answered is on the golf course.” ― Billy Graham Another fine day at Beauty Bay. Well, it was fine for most of us. It was exceptional for one of us! Congratulations to Leo Heyens on his hole-in-one on number 14. What a thrill! The celebration continued into the clubhouse after the round where Leo kindly bought his pals a beverage.
Beauty Bay Golf Course, Senior Men’s League, August 15, 2023
By Bruce Braun “Give me golf clubs, fresh air, and a beautiful partner, and you can keep the clubs and the fresh air.” – Jack Benny, American Comedian. Another beauty day at Beauty Bay! 67 members and 12 guests completed this Tuesday’s roster. It’s not too late in the season for any interested individual in joining us. If you’ve never been out, please join us as our guest. You do not need a special invitation from a member to test the waters.
Beauty Bay Golf Course, Senior Men’s League, August 8, 2023
By Bruce Braun “I'm getting better at golf now because I'm hitting fewer spectators”. – Gerald Ford. With questionable weather in today’s forecast 64 senior men’s league members with 8 guests still optimistically showed up for their Tuesday opportunity. Depending on your perspective, it might be fair to say that the weather did remarkably well. It did rain off and on lightly for a few holes. “I feel damp,” summarized one member after their round.
Beauty Bay Golf Course, Senior Men’s League, July 25, 2023
By Bruce Braun If profanity influenced the flight of the ball, the game of golf would be played far better than it is. – Horace G. Hutchinson, 2-Time British Amateur Champion. Today our league of 70 members and 9 guests successfully dodged questionable weather. Only a few insignificant raindrops fell and skies rumbled on our final holes. At the conclusion of the round an incredibly large clap of thunder culminated today’s golf.
Beauty Bay Golf Course, Senior Men’s League, July 18, 2023
By Bruce Braun Golf is a game of ego, but it is also a game of integrity. The most important thing is you do what is right when no one is looking. Submitted by Dennis O’Sullivan. We will start out on a somber note. This morning the senior men’s league paid their respects to past members who are no longer with us. This annual event, like so many others interrupted by Covid, was restarted after a few year hiatus. The group of 72 members and 5 guests gathered on the hill top ninth tee.
Beauty Bay Golf Course, Senior Men’s League, July 11, 2023
“I went to play golf to try and shoot my age, but I shot my weight instead.” – Bob Hope Today was yet another beautiful day to be out on the golf course. A beauty day at Beauty Bay! 68 members and 4 guests rounded out our league play this week. If you haven’t been out yet, there’s still plenty of room and we’d love to have you join us. The Beauty Bay senior men’s league matchplay competition is well underway. Pictured here are Russ Garneys and Marvin Koski.

More‐Than‐Human and Deeply Human Perspectives on COVID‐19
Abstract This multi-authored contribution explores what the COVID-19 pandemic demands of critical inquiry with a focus on the more-than-human. We show how COVID-19 is a complex series of multispecies encounters shaped by humans, non-human animals, and of course viruses. Central to these encounters is a politics of difference in which certain human lives are protected and helped to flourish while others, both human and animal, are forgotten if not sacrificed.
7th Circ. Ruling Forms Split On CAFA Jurisdictional Discovery
Law360 (November 25, 2019, 5:12 PM EST) -- A recent decision by the U.S. Court of Appeals for the Seventh Circuit left in its wake a circuit split affecting the class action bar. The issue dividing the circuits is whether federal courts can permit discovery to determine diversity jurisdiction in cases removed under the Class Action Fairness Act of 2005, also known as CAFA. The Seventh Circuit says yes. The U.S. Court of Appeals for the Eleventh Circuit says no.
Column: Support growing for school choice
Given the immense amount of political polarization in our country today — when Americans seem to disagree on everything but the color of the sky — it might surprise you to learn that an innovative policy commands overwhelming support from Michigan residents of all political stripes. That popular policy is school choice. The National School Choice Week (Jan. 22-28) celebration offers a timely moment to consider the support for educational opportunities Michiganians have voiced.
