Does the Foreign Emoluments Clause Apply to Elon Musk?
The role of Elon Musk, the world’s richest man, in the Trump administration has prompted concerns over ethics, transparency, and corruption. First, President Trump and Musk himself claimed that the Tesla CEO was in charge of the Department of Government Efficiency (DOGE), with the White House later announcing that he is a “special government employee” (SGE) and thus subject to looser ethics requirements than normal federal workers.
Election 2024 Real-Time Litigation Tracker
In this new publication for Election Week 2024, we track the most important breaking election cases across the country. This tracker complements our weekly top 10 major case list from the pre-election period with real-time analysis of developments in those cases and in new ones filed on or after election day while the count continues. The cases below are organized by state; in the interests of time we do not attempt to rank them.
Top 10 Election Litigation Cases in 2024 Implicating the Rule of Law
Most of the major election cases we have been tracking in this weekly digest have now been resolved—although a few remain open and new ones (perhaps many) can be expected on and after Nov. 5. On Oct. 23, Pennsylvania’s highest court came down in favor of the right to cast a provisional ballot if a voter’s mail-in ballot contains errors, in a ruling the U.S. Supreme Court on Friday declined to disturb.
Top 10 Election Litigation Cases in 2024 Implicating the Rule of Law
In the lead-up to the 2024 election, hundreds of election-related lawsuits brought across the country present a complex litigation landscape well before all ballots are cast and counted. Many of these cases have clear echoes of the 2020 presidential election, seeking to raise unfounded fears of voter fraud or false claims of ineligible immigrant voting, to erode confidence in mail-in and absentee voting, or to encourage baseless non-certification of eventual election results.
The counties that may try not to certify the 2024 election
One of the many strategies that could be used to confuse and delay the results of the 2024 election is the refusal to certify elections, particularly at the county level. We have already seen this tried in places like Cochise County, Arizona in 2022 and Washoe County, Nevada in 2024, and similar efforts seem to be percolating now in counties across the nation. It failed in those places and elsewhere but may be tried again in November.

Counting the votes in 2024-What you need to know about certification
In the immediate aftermath of the 2020 presidential election, at least 17 county election officials across six swing states attempted to prevent certification of county vote totals, many citing unsubstantiated claims of voter fraud in an attempt to justify their actions. This widespread effort to block certification in 2020 was unprecedented. Though the attempts failed across the board, contested certifications can potentially sabotage democratic elections around the United States.
A 2024 Election Litigation Hot List
With fewer than 50 days left until Election Day, dozens of lawsuits in battleground states across the country present a complex litigation landscape well before all ballots are cast and counted. Some of these cases have clear echoes of the 2020 presidential election, seeking to raise exaggerated fears of voter fraud, erode confidence in mail-in and absentee voting, and empower local administrators to refuse to certify election results.
