Colorado Bill Places Limitations on AI Use in Wage Setting
Recently, the Colorado legislature sent a bill, HB 26-1210, to Governor Jared Polis’ desk that would place limitations on the use of artificial intelligence to either 1) set prices for consumers; or 2) set wages for employees. Governor Polis vetoed the bill, citing vague and overly broad definitions in the bill’s text. But the conduct prohibited in the bill has been the subject of numerous bills in legislatures all across the country.
Zozo and the Lost Dreams brings Saturday-morning-cartoon charm to metroidvanias
Metroidvanias and I don’t tend to get along very often, perhaps thanks to a lack of enthusiasm for backtracking, a desire to keep pressing forward and exploring, or simply an absurd fear of getting lost in a needlessly complex map. Zozo and the Lost Dreams didn’t give me much reason to feel any of that, though; if there’s one thing this demo isn’t, it’s frustrating.

The results are in: attorneys are filing more employment law cases in court. Indeed, year-end reporting from legal databases like LexMachina confirm that the pace of filing new employment discrimination cases reached its highest level in 2025, surpassing 20,000 new filings nationwide.
Designing agentic workflows: where agents fail and where we fail
Agentic coding increases throughput. It also increases the probability that we ship something we didn't mean to ship. Both the agent and the review process tend to optimise for visible success signals: green tests, plausible diffs, confident summaries, "done".

Illinois Expands Human Rights Act for Employees with Family Care
Effective January 1, 2025, Illinois protects from discrimination employees who provide personal care to family members. In so doing, Illinois joins several other states that provide a cause of action to employees who believe they face discrimination on the basis of “family responsibilities.” The Law House Bill 2161 amends Illinois’ existing Human Rights Act, the state’s version of Title VII of the Civil Rights Act of 1964.

AI for HR: Managing the risks of disparate impact discrimination
It is no secret artificial intelligence is increasingly marketed to human resource professionals as a panacea for a host of workplace tasks. Many AI tools are designed to streamline and enhance hiring, while others are designed to eliminate bias and improve business processes for performance evaluations and assessments. While most AI tools can safely improve speed and efficiency, whether an AI tool actually eliminates human biases is not guaranteed.
A Bill of Rights for the Information Age: White House Outlines Principles for Artificial Intelligence Design & Use
It is no secret that legislators and regulatory agencies have taken note of companies’ increasing reliance on artificial intelligence (“AI”). In the employment context, vendors market AI as an efficiency tool that can streamline HR processes and guard against human bias and discrimination. But as we have previously blogged, undisciplined use of AI may accelerate or introduce discrimination into the workplace. Earlier this month, the White House waded into this discussion.

What are the Risks of Paying Employees in Cryptocurrency?
A small but growing number of employees are asking for cryptocurrency as a form of compensation. Whether a substitute for wages or as part of an incentive package, offering cryptocurrency as compensation has become a way for some companies to differentiate themselves from others. In a competitive labor market, this desire to provide innovative forms of compensation is understandable.
Philadelphia and Montana Join List of Jurisdictions That Provide Protections for Recreational Marijuana Use
Lost in the weeds of recent COVID-19 news is the increasing number of states and localities that have legalized medicinal and recreational use of marijuana. Such legalization brings with it varying degrees of worker protections and employer obligations. Philadelphia, PA and the state of Montana are two of the latest jurisdictions to add their names to the sprouting list of jurisdictions that protect not only medical use, but also recreational use of marijuana.
Religious Objections to Vaccine Mandates: EEOC Issues New Guidance
Last week, the EEOC issued new guidance on how to apply anti-discrimination laws to an applicant or employee’s request for a religious exemption from an employer’s COVID-19 vaccination requirement. Background: Title VII and Religion The EEOC has previously explained that vaccine mandates are generally permissible, as long as there are exceptions provided for disability and religious reasons.

Employers Beware: The EEOC is Monitoring Use of Artificial Intelligence
Earlier this month, the Equal Employment Opportunity Commission (EEOC) held a webinar on artificial intelligence (AI) in the workplace. Commissioner Keith Sonderling explained that the EEOC is monitoring employers’ use of such technology in the workplace to ensure compliance with anti-discrimination laws. The agency recognizes the potential for AI to mitigate unlawful human bias, but is wary of rapid, undisciplined implementation that may perpetuate or accelerate such bias.

Fourth Circuit Holds that the Federal Arbitration Act Does Not Prohibit Parties from Waiving Appellate Review
Thursday, June 17, 2021 Since the Supreme Court’s 2018 Epic Systems ruling, employers increasingly rely on arbitration agreements for more efficient resolution of both single plaintiff and class action claims. Prolonged judicial review of arbitration awards, however, can dilute that efficiency. As a result, some employers include waivers of judicial review, in whole or in part, in their arbitration agreements. But are such waivers permissible?

Seventh Circuit Decertifies Ambient Sexual Harassment Class of Plaintiffs
The Seventh Circuit Court of Appeals recently decertified a class of female correctional facility employees who alleged gender discrimination based, in part, on a theory of “ambient” harassment. The opinion underscores how the individualized nature of harassment claims can act as a barrier to class certification.

Numerosity and Rule 23: It’s Not (Only) About the Numbers
Last month, the Seventh Circuit Court of Appeals rejected a proposed class of thirty-seven employees for failure to satisfy Federal Rule of Civil Procedure 23’s numerosity requirement. “Much ink has been spilled” over the requirements of Rule 23, the Seventh Circuit noted. But only a small share of those cases concern the numerosity requirement. Most opinions deal with commonality or typicality. Recognizing this paucity, the court took occasion to outline the parameters of the numerosity factor.

Can Voluntary Individual Settlements Moot Class Actions? Yes, Depending on the Facts, According to the Ninth Circuit
The Ninth Circuit Court of Appeals recently clarified that a named plaintiff gives up his or her right to represent a class if, in an individual settlement, he or she does not carve out from the settlement a concrete financial interest in the putative class action. In so holding, the court explained that it was not enough for a plaintiff to generically carve out “class claims,” without identifying a more specific financial stake that would remain in the outcome of the class claims.

As COVID-based Class Actions Loom, Fifth Circuit Provides Reminder for Arbitration Agreements and Class Action Waivers
A recent Fifth Circuit opinion held that a company’s arbitration agreement did not prevent employees from pursuing their claims as a collective arbitration, rather than individual claims. As class claims related to COVID-19 begin to surge, the opinion provides occasion for companies to review their arbitration agreements to ensure that the companies’ aims are clearly drafted. COVID-19 The harm COVID-19 has wrecked on workplaces is no secret.
Navigating Employee Media Communications in the Age of COVID-19: A Recent NLRB Decision Provides Useful Guidance
Almost overnight, COVID-19 has radically altered the American workplace. Employers and employees alike have been forced to adapt to unique issues related to employee health, compensation, leave, and in unfortunate circumstances, furlough or lay-off. Such change may be accompanied by grievances, concerns, and fears. And in some instances, employees will desire to communicate those anxieties to the greater public at large.
Lost in Translation: Court Denies Class Certification to Chipotle Workers Alleging Unlawful English-Only Policy
Last month, a court in the N.D. of California denied class certification to a group of Chipotle workers who alleged that the burrito chain maintained unlawful English-only workplaces in the state of California. Guzman v. Chipotle Mexican Grill, Inc., Case No. 17-cv-02606 (N.D. Cal. Jan. 15, 2020). The opinion is a textbook example of how a lack of uniform written policies can, in some instances, benefit employers defending pattern and practice lawsuits.

As a transformational year recedes, here’s a look at what 2017 holds in store: The only Google update to have so far been confirmed for January is a move to potentially penalise sites for the use of intrusive interstitials. The update pencilled for January 10th – although relevant to desktop as much as mobile – is likely the first of many mobile-first oriented updates we’ll be seeing this year.
Lack Of Prejudice Results In Limited Sanction Against Defendant
In one of the first cases interpreting newly amended Fed. R. Civ. P. 37, , 15-cv-01129-HSG, 2016 U.S. Dist. LEXIS 176873 (N.D. Cal. Dec. 21, 2016), Magistrate Judge Maria Elena James of the Northern District of California denied plaintiff’s motion to exclude spoliated evidence that was relied upon by defendant’s expert, reasoning that the plaintiff failed to show sufficient prejudice to warrant such a sanction.
Why we built a “puppy news” bot
So it’s official, the animals have won. Bunnies rule the land, cats have revolutionized advertising, and as we recently learned from John Oliver’s Last Week Tonight puppies are here to conquer publishing. Readers are more interested in “puppy dogs” than Iraq, and the reader is always right, says Tribune owner Sam Zell (he also says f*ck you to his staff, nice). I’m a startup founder at Socius working on new tools for publishers to grow and engage their audiences.
