VIRAL JUSTICE OP-ED: Why not supporting the TRIPS Covid-19 waiver contravenes international human rights
On 18 January 2021, the director-general of the World Health Organization (WHO) warned that the world was on the brink of a “catastrophic moral failure” if wealthier nations did not ensure the equitable distribution of vaccines to combat the SARS-CoV-2 pandemic. Yet, more than 10 months later, not much has changed. The iniquitous global maldistribution of Covid-19 vaccines persists and is now widely acknowledged as constituting “vaccine apartheid”.
Supporting the TRIPS COVID-19 waiver is an essential step to support international human rights
A waiver would be a vital step for expediting the scaling up of manufacturing and provision of COVID-19 medical products. A nurse prepares a Sinopharm coronavirus vaccines against Covid-19 at Parirenyatwa Group of Hopsitals in Harare, Zimbabwe in November 2021. Border testing and movement controls have been put in place and being tightly enforced for travellers crossing into Zimbabwe after the outbreak of the Omicron variant of coronavirus in South Africa and Botswana.

Closing the doors of justice? The South African Constitutional Court’s approach to direct access
Legal interventions can help improve poverty and inequality, but in South Africa the poor don’t have sufficient access to courts. Photo: Flickr/Harvey Barrison (Some rights reserved) Can the South African Constitutional Court better serve South Africans by hearing more direct-access cases? While there is some debate on the extent to which the law can improve implementation of economic and social rights, this much is clear: if the law is going to help at all, the poor must have access to courts.
Seizing opportunities and broad strategy both essential in human rights litigation
To bring real human rights change, legal actions usually need to be linked to broader political strategies, but that doesn’t preclude seizing opportunities as they arise. Victoria Bera and Esther Kiobel, two widows who lost husbands to execution in 1995, file a civil court case in the Netherlands.
Mobilizing international human rights to challenge coronavirus vaccine apartheid

Mobilizing international human rights to challenge coronavirus vaccine apartheid
Beyond the looming humanitarian and moral catastrophe of COVID-19, lie opportunities for mobilizing international human rights law to compel states to take action, not merely in their own jurisdictions, but also globally. Litigating rights under occupation
Israeli occupation is the root cause of Palestinian suffering. Litigation won’t change that, but it has nevertheless proven a successful tactic to defend Palestinian rights.
OP-ED: LOCKDOWN BLUES: Lockdown Blues: Covid-19 in a place of inequality – towards a spatially contextualised mitigation plan
The photo below shows parts of the informal settlement “wetlands” on the west boarder of Masiphumelele… a few hundred meters is the security village of Lake Michelle. Almost no space for social distancing in Masi. (Google Earth) Around the world, the Covid-19 pandemic is shining a stark light on structural inequalities. Data from US cities reveal that African American and Latin communities are disproportionately contracting, and dying from, Covid-19. There appear to be several reasons for this.
Human rights-tackling inequality by catalyzing the agents of social change
Some argue human rights are insufficient to tackle inequality but overlook the emancipatory power of rights—to create the space to mobilize for change, a dynamic evident in rights litigation in South Africa.
Community Paralegals and the Pursuit of Justice
The United Nations estimates that four billion people worldwide live outside the protection of the law. These people can be driven from their land, intimidated by violence, and excluded from society. This book is about community paralegals - sometimes called barefoot lawyers - who demystify law and empower people to advocate for themselves. These paralegals date back to 1950s South Africa and are active today in many countries, but their role has largely been ignored by researchers.
India’s Supreme Court is making landmark judgements in social change
Photo: EPA/EPA PIYAL ADHIKARY The last couple of years in India have seen radical change on different fronts. With the Bharatiya Janata Party (BJP) coming to power in 2014, we have witnessed the stifling of civil society and liberal voices, and increasing violence against minority groups. The government has shut down NGOs and civil society organizations by curbing their funding, arrested civil rights defenders, and attempted to curb strong, dissenting voices.
Strategic human rights litigation in tough times
Photo: EFE/EPA Michael Reynolds Rather than a set of teachable skills, strategic litigation is the talent to turn a social problem into a vision of an actionable court case. When strategic litigation is aimed at defending human rights, its political meaning varies from society to society. The integrity of the justice system and judicial culture are the most important factors to be taken into account when investing in strategic litigation.
Expropriation assumptions reflect misunderstanding of Constitution
Yet both of these assumptions reflect a misunderstanding of the law, possibly exacerbated by a conflation between the law on the one hand, and political will and the implementation of policy on the other hand.
