On March 27, 2023, the Minister of Housing and Diversity and Inclusion introduced amendments (the “Amendments”)1 to the regulation (the “Regulation”)2 enabled under the federal Prohibition on the Purchase of Residential Property by Non-Canadians Act (the “Act”) which attempt to provide further clarity on this new prohibition.3 The Amendments came into force the very same day they were introduced.

On December 21, 2022, the Canadian federal government released the Prohibition on the Purchase of Residential Property by Non-Canadians Regulations (the “Regulations”)[1] made pursuant to Section 8 of the recently enacted Prohibition on the Purchase of Residential Property by Non-Canadians Act (the “Act”).[2] The Act prohibits the purchase of residential real estate by non-residents, directly or indirectly, for a two-year period beginning January 1, 2023.
