Errors By A Surgeon Cause A Rare Spinal Injury
I recently settled a rather unusual spinal injury clinical negligence claim. For approximately 2 years following the development of back pain whilst moving a heavy load, my client, who was the Claimant, suffered with left-sided sciatica due to L5/S1 intervertebral disc degenerative disease and disc herniation, with left S1 nerve root compression and resulting radiculopathy, confirmed by MRI scan.
Review of ‘Good Medical Practice’ by the General Medical Council
The General Medical Council (GMC) provides its core guidance on the standards of patient care and professional behaviour, which it expects of all medical professionals registered with it, in the form of a booklet called ‘Good medical practice’. The booklet was last updated a decade ago in 2013 and is currently undergoing review. The proposed changes follow a period of consultation undertaken by the GMC between April and July 2022.
Review of the clinical negligence pre-action protocol
On 15 November 2021, the Civil Justice Council (CJC) produced an Interim Report entitled “Review of Pre-Action Protocols (PAP)” for consultation on the subject of the PAPs, in which it canvasses a number of options for their reform. The consultation is based on answering questions via a particular form which can be submitted online. The review includes the clinical negligence PAP, known as the PAP for the Resolution of Clinical Disputes (PAP-RCD).
How do you choose your private hospital and consultant?
A few months ago, I wrote a blog about patient safety in the private healthcare sector in which I flagged some concerns about patient safety in that sector. This was based primarily on my experience over the years as a claimant solicitor acting for clients in cases against private hospitals and doctors but also from my (now rather distant) personal experience as a Resident Medical Officer junior doctor working in a private hospital.

An interesting case in which judgment was relatively recently handed down is that of Thomas Bradfield-Kay v Marcus Cope [https://www.bailii.org/ew/cases/EWHC/QB/2020/1351.html] EWHC 1351 (QB) concerning the application of Bolitho to an orthopaedic clinical negligence case.
New NHS recruitment: quality not just quantity | Lexology
United Kingdom
December 24 2019 The new government’s promise of extra cash, staff and hospitals for the NHS is welcome. The details are, of course, yet to be finally ascertained and it remains to be seen exactly how much in the way of funds and how many staff will be provided.
A summary of some of the post-Montgomery cases | Lexology
In November 2018 I gave a talk at the Bond Solon Annual Expert Witness Conference during which I attempted to summarise the impact of the Supreme Court judgment in Montgomery some 3½ years on from the original decision. The research for the talk, and the findings with respect to the impact that the case has had were quite insightful, although perhaps not overly surprising.
