Oregon federal judge applauds racial discrimination
OPINION: A Biden-appointed federal district court judge, Mustafa Kasubhai, spoke at the recent University of Oregon School of Law graduation. Yet instead of exhorting graduates to respect the rule of law and to treat all citizens as equals regardless of race, he pushed his radical views on diversity, equity and inclusion, calling DEI “absolutely intrinsic” to equal justice under the rule of law.
What SCOTUS Ruled About Conversion Therapy in Chiles v. Salazar
Can the government prohibit what a therapist says to a client behind closed doors? March 31, in an 8-1 opinion, the U.S. Supreme Court answered that question with a firm “No.” But the fact of an overwhelming majority of the Court—eight justices—also suggests the narrowness of the opinion itself. Indeed, Justice Neil Gorsuch’s majority opinion recognized that the “question before us is a narrow one,” blocking only the application of the state law as applied to a therapist counseling her patients.
Federal Appeals Court Holds That DHS Can Detain Illegal Alien Without Bond
Earlier this week, a federal appeals court held that the Department of Homeland Security (DHS) could detain an illegal alien without bond pending his removal proceedings after he was arrested in Minneapolis in 2025. In journeyman fashion, the Eighth Circuit Court of Appeals interpreted the applicable immigration laws as written and applied common sense to reach its decision.
Justices Unanimously Hold That Restitution Under Victim Act Is a Criminal Penalty
Victims of crime, especially violent crime, are not mere witnesses. They have a special status under state and federal law and are entitled to certain rights, including the right to be heard, to be treated fairly, and in some cases, to get restitution. Until Tuesday, it was an open question of whether the restitution owed to them by the convicted defendant was part of the criminal punishment.
Judicial Smackdown: Judge Boasberg vs. the Constitution
It’s a tale fit for a thriller novel or action movie: planes on the tarmac waiting to take members of a violent gang to a foreign prison, lawyers rushing to the courthouse to stop them, presidential proclamations, and a judge on a mission to impose his own brand of justice. But this drama isn’t made up—it’s very real, and it’s playing out right now in Washington, D.C. Leading the cast is President Donald Trump, who wants to rid the country of a violent gang.
Come October, We’ll All ‘Keep Hangin’ On’ Waiting for the Decisions of the Supremes
On Oct. 6, just a few short months from now, the Supreme Court marshal will utter the traditional “Oyez! Oyez! Oyez!”—marking the start of yet another Supreme Court term. The court’s last term, which ended in June, featured hot-button topics ranging from nationwide injunctions to parental rights to religious liberty, and it delivered no shortage of important rulings that will spark debate for years to come.
