Can an employer give a “bad” reference?
An employer’s duty when giving a reference is to be fair, truthful, and accurate. Therefore, the reference must reflect the individual in question and be realistic, not too glowing if this is unjustified, and not too negative is this would leave a misleading impression. References are a tough legal area for employers as getting it wrong can lead to liability for negligence, discrimination, defamation, or data protection breaches.
Menopause in the workplace | World Menopause Day
Earlier this year, an office worker was awarded compensation after her employer said that menopause was her “excuse for everything” and made her position in the company “untenable and intolerable”. The employment tribunal heard Mrs Anderson had called in sick to work after experiencing heavy menopausal bleeding and offered to work from home instead. In response to this she was told by her boss and company director to “just get on with it” as “everyone f****** gets it”.
Is relocation worth it? The risks for employers explained
The COVID-19 pandemic saw many changes to businesses and the way that people work. As a result of these changes and the economic slowdown, employers across the country are downsizing or moving to new premises and asking staff to relocate with them. It’s important that employers consider the impact a relocation will have on employees even if the distance is short or its not a permanent move. Any plan to move needs to be planned out well and include consultation time with employees.

This follows evidence from past reviews that black and ethnic minorities face disadvantages in the workplace.
What is the “without prejudice” rule in employment law?
The “without prejudice” rule generally prevents communication that is made in a genuine attempt to settle an existing dispute from being able to be put before the court as evidence. How is “without prejudice” used in employment law disputes? Its main purpose is to allow negotiations to take place freely when an employer and employee have a dispute. It works on an off the record basis with a view to trying to settle the dispute before it goes to tribunal or court.

Flexible Working Bill 2023
In July, the government’s Flexible Working Bill completed its final stage in the House of Lords and has been granted Royal Assent. Why has the Flexible Working Bill been introduced? As of a few years ago, flexible working was considered a luxury perk only offered by those employers who were progressive in their thinking. In 2016, a survey showed that just 8.7% of job vacancies advertised were considered flexible, but now around 58% of UK businesses currently offer flexible working in some form.
