Adjudicators’ terms and fees probed in UK construction dispute
In England, Judge Peter Coulson QC (as he then was) came to the same conclusion in 2006, noting that an adjudicator’s contractually imposed lien was “contrary to s.108 of the 1996 Act, which envisages both completion and communication within the 28 day period. I venture to suggest that an open-ended extension of the kind envisaged by the adjudicator is contrary to the whole principle of adjudication as described in the 1996 Act”.

The Technology and Construction Court (TCC) said the adjudication award of over £950,000 should be stayed ahead of the substantive trial of the dispute, due to the probable inability of surveying company JRT Developments to repay the sum awarded if the trial goes against it.

The Court said the contractor was able to enforce the later decision over the value of work carried out as a variation on a contract, despite an earlier adjudication where the adjudicator had found the variation was valid but its value was nil. Contractor John Sisk & Son was carrying out work for Hitachi Zosen Inova on the construction of a new power plant at Ferrybridge in Yorkshire.
