Germany has completed a far-reaching reform of its product liability regime to implement Directive (EU) 2024/2853. The new framework, which becomes applicable on 9 December 2026, extends product liability rules to software and AI-related technologies while strengthening claimants' procedural tools through broader disclosure rights and evidentiary relief.
On 8 October 2026, the German Bundestag adopted the Act to Modernize Product Liability Law in its second and third readings, concluding a legislative process that began in March 2026. The reform implements Directive (EU) 2024/2853 and represents the most significant revision of Germany's product liability framework since the Product Liability Act entered into force in 1989.
