17 States Challenge California Packaging Law With National Supply Chain Stakes
On June 22, 2026, 17 states, led by Nebraska, along with the National Association of Wholesaler-Distributors (NAW), sued California regulators and the Circular Action Alliance (CAA) in federal court, seeking to invalidate the state’s landmark packaging law, SB 54 (SB 54 or the Act). The lawsuit, Nebraska v. Heller, is the first coordinated, multistate attack on the broader “extended producer responsibility” (EPR) model gaining traction for packaging regulation across the United States.
Washington Passes First Statewide Scissor Stair Reform
Washington just passed the United States’ first statewide bill reforming the building code to allow scissor stairs in apartment buildings. Scissor stairs comprise two interlocking stairways with two separate exits, enclosed and separated by fire-resistance rated walls. Op-Ed: Building Code Changes to Promote Better Multifamily Housing in Seattle
In 1973, Seattle Mayor Wes Uhlman tasked the Building Code Advisory Board with examining how the city’s building code could be modified to “encourage in-city living, redevelopment, and new construction.” Focused on reversing the city’s population decline and making city living more desirable, the Building Code Advisory Board’s recommendations were adopted into the 1977 Seattle building code and allowed apartment buildings taller than three stories to be served by a single staircase.
Noncompete Agreements: Updated Income Thresholds For 2025
As our readers know, in 2024 the Federal Trade Commission's (FTC) proposed regulation to eliminate almost all noncompete agreements did not come to fruition — at least for now. As we reported earlier this month, however, the failure of the FTC ban has not stopped states from sharpening their hostility toward employer noncompete agreements.

Disgorgement On The Table In Wisconsin For Tortious Interference With Employee Noncompete Agreements
2024 was a year in which there were significant developments with respect to restrictive covenants, particularly for employment noncompete agreements. As our readers are aware, the Federal Trade Commission (FTC) published a new rule that would have all but eliminated such agreements on a national basis — however, the rule was then found to be beyond the FTC's jurisdiction, and the law returned to a state-by-state application.
