This comes not long after insurance comparison sites were seemingly spared from the government’s proposed changes to lead generation laws. According to ASIC, the Court found “Choosi made representations to consumers that conveyed it compared products from a range of funeral and life insurers”. However, since July 2019, Choosi has only compared funeral insurance policies issued by Hannover.
CSLR special levy reforms hit the Senate
On 19 August, Financial Services Minister Daniel Mulino unveiled a suite of reforms covering several key areas of financial advice and superannuation, including the CSLR, and specifically the special levy disallowance period. At present, the disallowance period is 15 sitting days of each House – not calendar days – during which Parliament and relevant bodies can challenge and potentially disallow the proposed special levy instrument.
ASIC fines three super funds $118K
ASIC has issued six infringement notices for misleading investment disclosures to the Australian Retirement Trust (ART), Tetra Servicing (formerly Telstra Super), and Australian Meat Industry Superannuation (AMIST). The fine total $118,800, with each receiving two notices worth $39,600. ART and Tetra Servicing have paid, whilst AMIST has agreed to pay within a year.
Top 20% of firms serving more clients per adviser: CFS
Findings from CFS’s 10x program, which partners with advisers to “help them identify opportunities to improve performance, drive growth and better meet evolving client needs”, the top 20 per cent of advice firms serve an average of approximately 190 clients per adviser, compared to a national average of 136. This has not prevented quality service, according to CFS, with clients of the top 20 per cent more likely to contribute voluntarily to super.
Acclaim expands leadership to strengthen adviser relationships
Acclaim has named Tony Smith to the new position, stating the appointment will help deepen adviser relationships and support its next phase of growth under recently appointed chief executive Julie Hamilton and COO Aimie West. Smith brings more than two decades of experience in financial services distribution, business development and adviser relationship management, including more than a decade as ClearView Wealth Limited state manager, Queensland between 2012 and 2023.
Iress nabs Bravura CFO to support ‘next phase’
Neil Montford will commence in the role of 16 November. Monford joins Iress after three years as Bravura Solutions CFO and has over 20 years of international experience across several listed technology and financial services businesses.
Garry Crole hit with 10-year ban
Garry Crole has been banned by the regulator for 10 years from performing as a director or responsible manager or any function involved in carrying on a financial services business, effective from 4 September. ASIC said the ban is the result of ASIC’s concerns related to Crole’s former roles as director and responsible manager of InterPrac Financial Planning, a wholly owned subsidiary of Sequoia Financial Group.
‘All profit, no responsibility’: Diversa blaming everyone but themselves
At a joint parliamentary council on corporations and financial services on 4 September, Diversa Trustees Limited leadership were grilled on their conduct in relation to the First Guardian Master Fund and the firm’s application for financial assistance under Part 23 of the Superannuation Industry (Supervision) Act. This provision allows super trustees to seek financial assistance from the Financial Services mister to cover losses resulting from fraud.
