U.S. Patent Office Issues Additional Guidance On Use Of AI Tools
On October 30, 2023, President Biden issued the Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence. This Executive Order called upon the Federal Government to enact and enforce protections as to AI-related harms, including "in critical fields like healthcare, financial services, education, housing, law, and transportation," while promoting responsible uses of AI.
AI & Patents: USPTO Issues Guidance
As Artificial Intelligence (AI) continues to develop, it is increasingly being used to aid in developing new products and processes. As currently drafted, U.S. patent law limits the grant of patents to natural persons. Courts have ruled that AI systems cannot receive patents for fully AI-generated inventions. However, it has been unclear whether, and under what conditions, patents can be granted on AI-assisted inventions.
Patent Eligibility
A pair of bipartisan bills have been introduced in the Senate that address patent law. Senators Chris Coons (D-DE) and Thom Tillis (R-NC), the chair and ranking member on the Senate's Intellectual Property Subcommittee, have introduced the Patent Eligibility Restoration Act of 2023 which attempts to clarify which inventions should be granted patent protection.
