Thursday, July 22, 2021ANSM On July 19, 2021, the French ANSM and the DGCCRF published a joint briefing note intended to “provide an educational presentation of the terms of the definition of the Cosmetics Regulation (relating to nanomaterials) based on the control practice of the French market surveillance authorities.” It reviews the regulatory framework currently applied to checks and inspections carried out by the French authorities and indicates that it is also intended to contribute to...
Nanos today: definitions, harmonisation, formulator's challenges
To this day, nanomaterials are still the subject of debate. If only because of their very definition. On the regulatory side Which definition(s)? As a reminder, there are two of them.

Accumulation of Benzophenone by degradation of Octocrylene in cosmetic products
According to a scientific study published on 7 March 2021 in “Chemical Research in Toxicology”, Octocrylene contained in cosmetic products, including sunscreen products, degrades over time and generates Benzophenone, in proportions that may represent a safety risk for consumers. The authors of the study call on regulatory authorities to ban the manufacture and sale of products formulated with these two UV filters.

Chartres Congress 2020: the Q&A of the control authorities
Question – Claims Is the claim “Antibacterial” as a secondary function for a cosmetic product still allowed? And if so, under what conditions? Answer A product with biocidal status must contain at least one biocidal substance in accordance with Regulation 528/2012. A liquid hand soap meets the definition of a cosmetic product. If the claim “Antibacterial” is mentioned, this must, as with any claim, be appropriately substantiated. Above all, it must not be confused with a biocidal product.
DGCCRF: Report on controls and outlook for 2021
In 2019, the DGCCRF worked on three main themes: • The verification of the fairness of “natural” and “organic” claims • The control of the quantities sold and the presence/labelling of allergens in the perfume compositions • The use of nanomaterials in cosmetic products In this context, 1,257 establishments were checked, 43% of which presented at least one anomaly. 395 products were sampled and analysed by the joint laboratory service, and a third were found to be non-compliant.

What do EU citizens think about nanomaterials?
Despite manufactured nanomaterials being a common part of our everyday lives, this study found that general awareness about their nature, characteristics and properties is low. However, the level of awareness has increased compared to earlier surveys, and is expected to continue increasing in the future. The study identified some concerns over the safety of some established and newer applications of traditional and more advanced nanomaterials.

European consultation on the definition of a nanomaterial
In 2011, the European Commission adopted the Recommendation 2011/696/EU on the definition of nanomaterial. A common definition of the term “nanomaterial” across EU regulation supports a harmonised approach, facilitates implementation and enforcement, and can serve as the technical and scientific basis for EU legislation and policies that set provisions specific to nanomaterials. Member States are also invited to consider the definition in the Recommendation in their national legislation.
Ingredients news
ANSES Communiqué In the European Union, the definition of nanomaterials varies across sectors. The European Commission has launched a public consultation to review the definition of nanomaterials with a view to possible harmonization. In its response, ANSES calls for not excluding from this definition some nanomaterials that could be problematic for human health and the environment. Used in the composition of a wide variety of everyday products - food, cosmetics, drugs, etc.
Nano-TiO2: French ANSES recommends occupational exposure limit values
Titanium dioxide in nanoparticle form has been used for about 30 years, particularly for its ultraviolet and photocatalytic radiation absorption properties. In people exposed via the respiratory tract, it can in particular cause lung inflammation, which in some cases can lead to carcinogenesis. Several physico-chemical characteristics of TiO2-NP can influence its toxicity: size, shape, the presence or absence of a surface coating or crystallinity, making it a very complex substance.
