The AAUP’s revised concept of academic freedom
Last week, I wrote about the most recent dust-up between the American Association of University Professors (AAUP) and the Foundation for Individual Rights and Expression (FIRE), two organizations that understand their shared commitment to academic freedom in somewhat different ways.
Why Colleges Can No Longer Trust the Courts
In July, Columbia University settled with the federal government over alleged antidiscrimination violations, agreeing to pay over $200 million under terms that required further monitoring. That same month, Brown University agreed to a $50-million settlement and the University of California at Los Angeles reached a $6-million settlement in a lawsuit brought by Jewish students and faculty.

October 02, 2024 It’s more important than ever that faculty members be thoughtful about and understand the functions and limits of academic contracts, writes Peter F. Lake. You have /5 articles left. Chevron ruling brings management by judiciary (opinion)
You have /5 articles left. Sign up for a free account or log in. lucky-photographer/Getty Images Pro The Supreme Court’s Friday decision in the Loper Bright case, overruling the Chevron doctrine, signals a seismic shift for higher education compliance. Unfamiliar legal territory lies ahead: the Supreme Court has diminished the authority of federal regulators and increased the power of federal judges in regulatory matters.
On Laudianism: Piety, Polemic and Politics during the Personal Rule of Charles I
For a churchman whose career ended in disaster on the scaffold, Charles I’s final archbishop of Canterbury, William Laud, casts a very long shadow on English history. In the history of the Church of England, the aborted Laudian reforms represent a path not taken. Their importance has been magnified by the fact that they were claimed as an ancestor by the Oxford Movement.
AFL umpiring is hard but standards need to improve
Firstly let me say that we footy fans completely accept the fact that umpiring is a very tough job. Having said that I have to say that being an AFL umpire is the only job in town where somebody can go to work, make mindless errors, week in week out and still rule with an iron fist. They can do so even when it is obvious to all that he/she has blundered yet again and still get paid a handsome wage for doing so.

Nowcasting the Australian Labour Market at Disaggregated Levels
Abstract Detailed labour market and economic data are often released infrequently and with considerable time lags between collection and release, making it difficult for policy-makers to accurately assess current conditions. Nowcasting is an emerging technique in the field of economics that seeks to address this gap by ‘predicting the present’.
Peter Lake, the World's Only Anonymous Singer-Songwriter, Original
NEW YORK, Aug. 08, 2022 (GLOBE NEWSWIRE) -- In his newly released single called ACORNS, Peter Lake attempts to give a voice to the sign of the times. Without forcing a judgment on a range of topics from the stock market to fossil fuels, Lake summarizes the range of topics that seem to define the times, and which he feels should be cataloged for our "collective memory." Lake suggests that history is often forgotten, but music can be a special tool that helps us remember.
How to Protect Faculty Members From Outside Attacks
This essay is excerpted from a new Chronicle special report, "Building a Faculty that Flourishes," available in the Chronicle Store. Most faculty members can remain largely anonymous outside the world of higher education for their entire careers, never attracting public attention, let alone public ire.

Peter Lake, One of the World's Only Anonymous Original
NEW YORK, May 12, 2022 (GLOBE NEWSWIRE) -- Peter Lake, one of the world's only anonymous singer-songwriter, strikes again with his brilliant and catchy EP, entitled "Black&White." Says the artist, "This one doesn't suck; it's a real thing." The Black&White EP was released last week after a very busy 18 months, in which Mr. Lake has come onto the scene slowly, and then all at once. His popularity is reflected in his millions of YouTube and Spotify streams alone.
Stay Baby Stay (Like a Lullaby) Original
He does this one sitting at his new favourite studio, Quad, in New York City. After a short conversation with video game producers, Lake decided to embrace the desire to write a song that would preserve the melodies we've come to expect, while also creating a track inspired by gamers and classic House music. In the studio, Lake decides to ''destroy and rebuild'' a slow melodic ballad that was mastered and primed for release.
Open Letter to Texans: Powering Forward
Audio articles on Wilson County News made possible by Richardson Bros Chevrolet in Floresville. The Texas electric grid is the strongest and most reliable it’s ever been. In fact, we all saw firsthand how much stronger and more reliable earlier this month as an arctic freeze took hold of Texas. We had ample energy, with plenty to spare. This letter is to all Texans – to you – to reassure and tell you why the lights will stay on this winter and why outages like last year will never happen again.
Advice | How to Adjust Your Employment Policies for the Covid Era
Academic-employment policies are designed to accommodate some level of uncertainty, but no colleges were prepared for the disruptions to our working lives caused by the global pandemic — or the many legal issues that have come along with it. Colleges can barely use the most equivalent situation in history to help guide them.

Compliance Audits - How to Prevent Major Title IX Issues | JD Supra
Institutions of Higher Education need to consider new approaches to Title IX compliance. We recommend proactive, periodic, non-incident related, and targeted operational compliance audits to get in front of Title IX issues before they become issues. Consider just one recent situation. Currently, there is an outside audit being conducted regarding Louisiana State University’s handling of sexual misconduct complaints.

Next Up in Title IX Compliance
Are we doing enough under Title IX to protect our staff or faculty being victimized…by students? Understandably, much of the focus of Title IX compliance since 2011 has been on protecting students. Plenty of data shows that student victimization is a major issue. Sadly, students (and sometimes minors on campus) have been victimized by other students, faculty, staff, or third parties. Numerous recent scandals underscore the risks to students.
St Margaret of York
On March 25th, 1586, naked but for a linen shift, Margaret Clitherow was crushed to death in the Toll Booth on the Ouse Bridge in the city of York. The sanction was known as the peine forte et dure. She was, we are told, ‘in dying one quarter of an hour. A sharp stone, as much as a man’s fist’, was ‘put under her back’.
In Times of Scandal, Conflicts With College Lawyers Multiply
It is highly unusual for a college trustee to call — publicly — for the institution’s general counsel to resign. Yet this recently occurred (via tweet, of all things) at Michigan State University, as the controversy surrounding Lawrence D. Nassar engulfed the administration. The trustee, Brian Mosallam, also demanded an "independent review" of how Robert A. Noto, the general counsel, had handled the Nassar investigation internally.
Mission Possible
Many modern higher education administrators routinely spend the day shuttling among various teams (sometimes called “committees” or “task forces,” inter alia) with a variety of charges. “Teaminess” has become a defining feature of today’s hyper-busy higher education culture. Teamwork can sometimes feel overwhelming and very demanding. Teamwork promotes positive legal outcomes. Here, I would like to stress three critical ways teamwork helps higher education meet legal obligations.
From Discipline Codes to Contractual Respect
Colleges today face a spectrum of student-related challenges: cheating, hazing, sexual violence, drug and alcohol use, discrimination, student debt, free-speech issues, and more. Yet many of the techniques we have relied on historically, such as using discipline or honor codes to enforce campus rules, seem insufficient to meet these issues. And the more we enforce our rules, the more we find ourselves in court — or at least in the court of public opinion — defending those rules.
Title IX... in Regulatory Limbo
Title IX compliance entered a new phase on September 22, 2017, when the U.S. Department of Education released “substantial” and “interim” guidance. The new guidance rescinds some, but not all, Obama-era guidance. For all its complexity, this dramatic regulatory maneuver has changed very little in actual operational compliance for most institutions.
A Blueprint for Title IX Compliance
ON APRIL 4, 2011, the US Department of Education’s Office for Civil Rights (OCR) issued major guidance on Title IX compliance. Since 2011 OCR has offered additional guidance, entered into a number of voluntary resolution agreements with institutions of higher education, and has recently engaged the field in active dialogue about the future of Title IX interpretation and enforcement. The volume and complexity of the regulatory communication can be bewildering, even for experts.
Compliance U -- College Planning & Management
As higher education has become more heavily regulated the roles of lawyers and legally trained individuals have evolved and expanded. Just 25 years ago it was unusual to have more than a single individual serving as general counsel on campus. In those days, the general counsel might have supervised compliance efforts and even some risk management efforts. Today, general counsel’s offices tend to be more heavily staffed — including working in concert with outside counsel.
The Hazards and Opportunities Presented by Title IX
Wise college leaders will seize the chance to publicize their successful Title IX compliance — attracting more students who want to feel and be safe.
The challenges and rewards of being a Title IX coordinator (essay)
At Stanford University, an athlete was convicted of sexually assaulting an incapacitated woman. Not long after that, the University of Tennessee at Knoxville agreed to pay $2.48 million to settle a lawsuit brought against it by a group of women who said they were sexually assaulted by student athletes. Indeed, it seems as if a week doesn’t go by without the issue of sexual violence at colleges and universities making the headlines.
