Lawyers need to be aware of overhaul of construction laws
An overhaul of construction laws has the potential to reduce the number of payment disputes and speed up the dispute resolution process, lawyers say. Law clerk awarded damages in dispute with lawyer

Taafe, 2018 ONSC 3150, law clerk Antoinette Curley sued Oshawa lawyer Lesley Mary Taafe for breach of a business agreement. The two had an arrangement where Curley would refer real estate clients to Taafe.

The lasting impact of the Forcillo conviction
Earlier this year, the Ontario Court of Appeal dismissed the appeal of former Toronto Police Service officer James Forcillo over his conviction of attempted murder and the resulting sentence of six years. It was a unanimous judgment by Chief Justice George Strathy, Justice David Doherty and Justice Gary Trotter. In my opinion, it was a brilliant, well-reasoned decision.

New AG to face significant challenges
Caroline Mulroney will face a series of challenges as Ontario’s attorney general, as lawyers look to her office to improve the efficiency of the legal system. Mulroney, recently appointed to the role, takes office as the legal landscape is confronting issues such as cannabis legalization and the need for technological upgrades in the courts system. How the province deals with these changes depends in part on how Mulroney allocates a shrinking budget and dwindling court resources, lawyers say.
No end to Mr. Big investigations after Hart
After the Supreme Court issued its ruling in July 2014 in R. v. Hart, which outlined a framework for trial courts to assess “Mr. Big” police undercover operations, the characterization of the decision by major media outlets and some legal scholars was similar. The judgment was described as requiring stricter rules for police and setting a high standard for any evidence obtained in these investigations to be ruled admissible.
The prime minister’s personal days
This past Canada Day, Justin Trudeau boarded the aging prime ministerial jet to embark on an ambitious one-day, cross-country, nation-celebrating jaunt. As part of the plan, he was expected to kick off the festivities in Leamington, Ont. at a street party hosted by employees of the century-old Highbury Canco tomato processing plant before heading west to join local steelworkers at an afternoon event in Regina, and then end his day at a community barbecue in Dawson City, Yukon.
Restraint urged for summary conviction appeal judges
The Ontario Court of Appeal has issued a reminder to summary conviction appeal judges that it should use restraint in any inquiry into how the lower court managed the trial process. “The jurisdiction of a summary conviction appeal judge is limited,” wrote Justice Ian Nordheimer in R. v. Polanco. “A summary conviction appeal judge is not entitled to retry the case or to substitute his or her own view of the evidence for that of the trial judge.
