Claiming Compensation For Injury Following Accidents At Work
My colleagues and I are often instructed to deal with claims on behalf clients who have been injured at work. A split-second act or omission would usually lead to life changing injuries, affecting them and their family lives forever. With support and early rehabilitation, some clients do regain a reasonable quality of life, but not the same 'old life' that was pre-accident.

Claiming Compensation For Injury Following Accidents At Work
It is not uncommon for claimants to be reluctant to bring claims for personal injury compensation following serious accidents at work. They may be employed, or self-employed and are understandably worried about taking steps that would adversely affect their employment even if they have suffered very serious and even life changing injuries. They may also feel a sense of loyalty towards their employers and colleagues.
Injuries resulting in death - is there a claim?
The loss of a loved one causes unimaginable pain and grief and nothing could ever compensate for that. However, in certain circumstances if the death was caused by a third party through their act or omission, whether through a road traffic collision or an operation that was performed negligently, there may be a cause for bringing a civil action for compensation. At a recent webinar, my colleague Katherine Browne and I discussed how such claims can be brought.

Investigating a personal injury claim and gathering evidence
United Kingdom December 7 2021 In my role as a specialist claimant personal injury lawyer, I am only too aware of the importance of investigating a case thoroughly and gathering all the evidence required in order to bring a successful claim on a client’s behalf. It is for the claimant to prove on the balance of probabilities (more likely than not), that a third party was responsible for causing their injury and any losses resulting from the accident.
Smith v Lancashire Teaching Hospitals NHSFT - a step in the right direction
The recent case of Jacqueline Smith (suing in her own right & as the surviving partner of John Bulloch, Deceased) v (1) Lancashire Teaching Hospitals NHS Foundation Trust (2) Lancashire Care NHS Foundation Trust (3) Secretary of State for Justice once again highlighted just how out of date section 1A of the Fatal Accidents Act 1976 (“the Act”) is.
Amending a claim form after expiry of the limitation period
It is fairly common to amend claim forms and other statements of the case when the need arises. This is often the case where instructions are received late on in the day and the claim form is issued just before limitation, when all the information may not be available or in cases where details of other/correct defendants come to light at a later date. A party may need to be added or to be substituted with another.
