NSW re-opens its door to foreign developers
The Berejiklian Government has introduced a Bill into the NSW Parliament which may change the way surcharge purchase duty and surcharge land tax applies to foreign developers. If passed, the Bill will provide that foreign-owned developers may be allowed a refund of the 8% purchase duty surcharge, and the 2% land tax surcharge, provided the land is acquired via a company incorporated in Australia and the development project is completed within 10 years.

Mind the Gap - GST and new residential properties
The Turnbull Government has released Exposure Draft legislation that proposes to implement the 2017-18 Budget measure of requiring purchasers of newly constructed residential properties or new subdivisions to remit the GST directly to the Australian Taxation Office (ATO) as part of the contract settlement procedure. The exposure draft has been released for industry consultation.
Budget 2017 Depreciation Deductions
IN the Federal Budget on 9th May, depreciation allowances forming part of an investors income tax deductions for second hand residential investment properties were effectively killed off. This will apply to the purchase of any second hand properties where the contract to buy is entered into after 7.30pm on 9th May 2017. Contracts entered into prior to this date will be grandfathered and deductions will still be able to be claimed. What this means is not entirely clear yet.
Government turns GST on its head for new property sales
OPINION: THE Budget measures include a radical plan to shift the responsibility of accounting for GST from property developers to purchasers. Under the proposal, purchasers must remit the GST directly to the Australian Taxation Office (ATO) as part of the settlement process. The proposal will apply to newly constructed residential properties and new subdivisions from 1 July 2018. What does this mean for the developers? The full impact for developers will depend on the final form of the legislation.

Surcharge tax hits discretionary trusts
The Office of State Revenue (OSR) has released a ruling on 22 December 2016 in relation to the definition a ‘foreign person’. This is important if you hold an investment property in a discretionary trust. The OSR ruling confirms that the trustee of a discretionary trust is deemed to be a ‘foreign person’ if the class of potential beneficiaries of the trust could include a foreign person, even if that person is not specifically named.
