Ancora v HTC America: restriction computer operations with license limitation eligible under Section 101
Sunday, November 18, 2018 In this case the Federal Circuit found a method of restricting software operations within a license limitation to be patentable advance, and in particular, the invention was found to be “a concrete assignment of specified functions among a computer’s components to improve computer security, and that this claimed improvement in computer functionality is eligible for patenting. PTAB Reverses 101 Rejection on Authentication Invention for MasterCard
In a recent PTAB appeal, Ex parte MICHAEL C. WARD, PATRIK SMETS, and PAUL VANNESTE (Appeal 2017-000625/Application 12/833,059) the Board reversed a 101 rejection against a patent application owned by MasterCard International, Inc. Claim 1 is recited below.
Is the Abstract Idea Exclusion A Big Mistake for Software, or is There Something Important To It?
As recently reported by Dennis Crouch, under Dir. Iancu, eligibility rejections have dropped to about 6.6%, from approximately 8% before that. Software patent practicioners are pleased to see the needle moving in the “right” direction, but still there are far too many worthy inventions being denied by the USPTO, the PTAB, and ultimately the Federal Circuit.

Patent applicants finding themselves in art unit 3600 are finding glimmers of hope at the PTAB. In two recent decisions, the PTAB reversed the Examiners’ Alice patent eligibility rejections. In both cases, the PTAB panel cited BASCOM[1] and found the claims at issue to amount to significantly more than an abstract idea when the claims were considered as a whole. In Ex parte Bhogal,[2] the claims at issue were directed to rendering objects in order based on bid values.
So, you are telling me there is a chance? PTAB Finds Anti-Fraud Idea Patentable
The PTAB shows us a little glimmer of the return of sanity to Section 101, with this decision that finds a claim to a credit card transaction verification algorithm patentable.
Sick Stats for Medical Software Innovations
Robert Sachs recently posted an interesting update on Section 101 prosecution stats here. One of the most disturbing stats related to medical software innovation. Inexplicably, it has been targeted as constituting largely only “abstract ideas” not worthy of patenting.
USPTO Applicants Face Dismal Odds in Finance-Related Arts, but Odds Good Outside US
As reported recently in The Bilski Blog, finance-related patent filings are being allowed at very low rate — 2.6% — so low in fact that the the “median number of allowances per examiner in the two years since Alice is one.” That means 1/2 case allowed per examiner per year.
