"As he reached the end of his acceptance speech at the Republican National Convention in 2024, J. D. Vance’s tone became more intimate. He began to speak of a cemetery in Kentucky where five generations of his family are buried, and where he hopes he and his children will be buried too. The cemetery matters to him because the bones in that graveyard—some belonging, he said, to people born “around the time of the Civil War”—represent a concrete reality, a homeland, a place that he will defend.

From Stewart to Squires: The PTAB’s First-Year Reset in IPRs and PGRs
Adversarial proceedings at the US Patent Trial and Appeal Board (PTAB) have undergone significant changes in just one year. The biggest change is not a single doctrinal development but a redefinition of institution itself. Institution decisions are no longer handled by panels of administrative patent judges.
USPTO Introduces Pre-Order Patent Owner Submission in Ex Parte Reexaminations
Ex parte reexamination proceedings now have a new twist: patent owners will have the option to file a pre-order paper before the Office determines whether a substantial new question of patentability (SNQ) has been raised. While a patent-owner statement was previously available after the SNQ determination, this new pre-order paper provides an earlier opportunity to persuade the Office that a request should be denied.
Selective sweep probabilities in spatially expanding populations - Nature Communications
Abstract Evolution during range expansions shapes biological systems from microbial communities and tumours to invasive species. A fundamental question is whether, when a beneficial mutation arises during a range expansion, it will evade clonal interference and sweep to fixation.
First Institutions Under Squires: Trends, Impact of Stipulations, and Practice Pointers
The Patent Trial and Appeal Board (PTAB) has experienced significant shifts in discretionary-denial policy over the last year. Under Acting Director Coke Morgan Stewart, PTAB expanded the bases for discretionary denial and introduced the settled expectations doctrine. And when Director John Squires assumed leadership, he reclaimed institutional authority and initially issued only summary denials.
USPTO Restores Pre-SharkNinja Requirement for Petitioners to Identify all RPIs Before Institution of Trial | JD Supra
The US Patent and Trademark Office (USPTO) has designated Corning Optical Communications RF LLC v. PPC Broadband Inc. as precedential, marking a significant shift in inter partes review (IPR) and post-grant review (PGR) practice. With this designation, the USPTO reinstates the pre-SharkNinja requirement that petitioners identify all real parties in interest (RPIs) before trial institution. The designation reflects concern over national security and patent system integrity.

USPTO Proposes New Institution Rules and Director Takes Over Merits-Based Institution Decisions
The US Patent and Trademark Office (USPTO) has announced two major, interrelated policy shifts: (1) proposed amendments that would limit the institution of inter partes review (IPR) proceedings in cases where validity has already been—or soon will be—adjudicated elsewhere, and (2) a reallocation of authority for America Invents Act (AIA) trial institution decisions back to the USPTO director.

Perioperative pembrolizumab, trastuzumab and FLOT in HER2-positive localized esophagogastric adenocarcinoma: a phase 2 trial - Nature Medicine
Abstract Perioperative treatment strategies for HER2-positive esophagogastric adenocarcinoma remain suboptimal. Here in the open-label, phase 2 IKF/AIO PHERFLOT trial, we evaluated the safety and efficacy of adding pembrolizumab and trastuzumab to FLOT chemotherapy in patients with localized HER2-positive esophagogastric adenocarcinoma. The primary endpoints are the pathological complete response rate and the 2-year disease-free survival rate.

On the patterns of genetic intra-tumour heterogeneity before and after treatment
Abstract Genetic intra-tumour heterogeneity (gITH) is a universal property of all cancers. It emerges from the interplay of cell division, mutation accumulation and selection with important implications for the evolution of treatment resistance. Theoretical and data-driven approaches extensively studied gITH in ageing somatic tissues or cancers at detection. Yet, the expected patterns of gITH during and after treatment are less well understood.
Federal Circuit Clarifies Scope and Timing of Collateral Estoppel for Claims Under IPR | JD Supra
In a recent opinion, the Federal Circuit added several new wrinkles to amendment practice in inter partesreview proceedings. The court affirmed the Patent Trial and Appeal Board’s determination that most of the original claims challenged by an IPR were unpatentable as obvious, and reversed the Board’s determination as to the sole surviving claim, concluding that it too was unpatentable as obvious.

A Look at Key USPTO Director Review Decisions and their Significance
“Looking at the Director Review (DR) decisions so far in 2024, preliminary observations show that the landscape around the DR process appears to be shifting from sua-sponte focused DRs to party-initiated DRs.” Prior to the Supreme Court’s 2021 decision in United States v. Arthrex, Inc., while there were some mechanisms for review of decisions by Patent Trial and Appeal Board (PTAB) panels, Director Review (DR) as a standalone review mechanism was essentially non-existent.

Arthrex, Inc., while there were some mechanisms for review of decisions by Patent Trial and Appeal Board panels, Director Review (DR) as a standalone review mechanism was essentially nonexistent. After Arthrex, however, that changed—with the US Patent and Trademark Office setting forth an interim DR process, followed by a revised DR process, and now formal rulemaking in April 2024.

The ubiquity of clonal interference in cancer and other range expansions
Abstract Evolution during range expansions shapes the fate of many biological systems including tumours, microbial communities, and invasive species. A fundamental process of interest is the selective sweep, in which an advantageous mutation evades clonal interference and spreads through the population to fixation. However, most theoretical investigations of selective sweeps have assumed constant population size or have ignored spatial structure.
Energia, bollette record. Federconsumatori: “Governo, Parlamento e ARERA intervengano subito”

A Tragedy in Maine
The first 911 call came in at 6:56 pm EST on Wednesday October 25th. A man with a military-style semiautomatic assault rifle was firing shots in a bowling alley in Lewiston, Maine. It was youth night. He then drove to a nearby bar where the rampage continued. 18 innocent people, folks at work or out enjoying an evening, were murdered (with the death toll likely to increase) and scores of others wounded.
