The UK Government has published its third annual report on the operation of the National Security and Investment Act 2021. The Act gives the UK Government powers to scrutinise and intervene in business transactions, such as takeovers, to protect the UK's national security. The latest annual report provides key data and statistics on how the regime under the Act has operated in the period 1 April 2023 to 31 March 2024.

In February 2024, we discussed (see our blog post The powers of the Competition and Markets Authority to search homes) a significant judgment of the UK Competition Appeal Tribunal (CAT) regarding the powers of the Competition and Markets Authority (CMA) to search an individual's home. The CMA issued a judicial review challenge against the CAT's decision and the High Court has now ruled that the CAT misapplied the law when it refused the CMA's request for a warrant to search domestic premises.
