Opinion | Israel Proves the Danger of an ‘Independent’ Justice System
With Republicans and Democrats incensed about politicized prosecutions, it is tempting to believe that the U.S. would be better off if elected officials were less involved in law enforcement. A growing scandal in Israel shows the perils of that approach. Israel has one of the most powerful and independent legal systems.

Jews Living in the West Bank Didn’t Undermine Israel’s Security or Empower Hamas
Shany Mor offers a critique of the konseptziyot (plural of konseptzia) that governed Israeli strategy before October 7, 2023. The Hebrew term “konseptzia” used to be shorthand for the assumptions that exposed Israel to its last security disaster: the Yom Kippur War, in 1973. The term connotes deadly groupthink. In the early 1970s, Israeli officials underestimated their Arab enemies’ intentions and capabilities; they did the same with Hamas before it massacred 1,200 Israelis last October.
For Lasting Peace, Keep the IDF in Gaza Original
Since the start of the Israel-Hamas War, the governments of Israel and the United States have disagreed about who should run security in the Gaza Strip after hostilities calm down. President Joe Biden and Secretary of State Antony Blinken want a multinational force without a substantial Israeli military presence. Prime Minister Benjamin Netanyahu insists that, whoever is tasked with street-level law and order, the Israeli Defense Forces will remain the predominant power inside Gaza.

Israel has the right - and the duty - to besiege Gaza Original
Israelis are still burying the 1,200 victims of the Saturday attack on southern Israel by Hamas, the Islamist terrorist group that seized power in Gaza in 2007. As the assault unfolded, terrorists raped women and dragged them through the streets. They decapitated babies in their cribs. They slaughtered entire families in their homes. Hundreds of civilians remain missing or held hostage in Gaza. The sheer evil of Hamas’ deeds exceeds what can be conveyed in words.
Israel’s judicial reform of its courts’ unchecked power is not as radical as activists would have you believe Original
Israel has been roiled by protests, boycotts, airport and road closures, wildcat strikes and refusals to perform army service, in scenes reminiscent of France, for half a year. The cause is judicial reform. The government announced plans to revitalize Israel’s parliamentary democracy by restoring separation of powers and curbing judicial overreach.
Israel Is in Need of Judicial Reform | SAPIR Journal
As I write, in March 2023, Israel is in the throes of an intense debate about judicial reform. While the intensity is new, the debate itself has been going on for decades. Proponents of reform have demanded actions for nearly 30 years, since then–Justice Aharon Barak and his colleagues on the Supreme Court carried out a self-styled “revolution” to remake Israel’s law and governing principles.

The Sheikh Jarrah property dispute and the false claim of Israeli land discrimination
(May 23, 2021 / JNS) The real estate dispute in Jerusalem’s Sheikh Jarrah neighborhood has played a crucial role in international accounts of the recent fighting between the State of Israel and the Hamas terrorist organization ruling the Gaza Strip. The Sheikh Jarrah dispute concerns several eviction orders issued by Jerusalem’s Magistrate Court, upheld on appeal by Jerusalem’s District Court and awaiting a ruling by Israel’s Supreme Court on a request for a final appeal.
Opinion | Almost Nothing You’ve Heard About Evictions in Jerusalem Is True
Hamas never needs a special occasion to bombard Israel with rockets. Yet the progressive narrative connects the terrorist group’s current onslaught to eviction proceedings in Israeli courts concerning a few properties in the Jerusalem neighborhood of Sheikh Jarrah. Sens. Bernie Sanders and Elizabeth Warren claim these are stark human-rights violations by the Israeli government, and illegal under international law.

The litigation has taken several years, and the owners have won at every step.

Israel Must Hit the ICC With Heavy Political Pressure
The International Criminal Court, The Hague, Netherlands. Photo: Wikimedia Commons. JNS.org – As expected, a pretrial chamber of the International Criminal Court (ICC) on Friday determined that a Palestinian state exists with jurisdiction in the Gaza Strip, Judea and Samaria, and eastern Jerusalem. In doing so, the ICC’s general prosecutor authorized an investigation into war crimes allegedly perpetrated in “Palestine.” The response to the ruling came quickly and was also predictable.
