The new EU foreign investment screening regulation: What is new and what it means for Denmark

Under the New FDI Regulation, all Member States will be required to introduce an FDI screening mechanism that complies with the minimum requirements set out in Article 4(4). This constitutes a step towards greater harmonisation across the EU. Nevertheless, national security will remain the exclusive competence of the Member States, as expressly provided in Article 4(2) TEU and reinforced by Articles 72 and 346 TFEU.

Den nye EU-forordning om screening af udenlandske investeringer: Hvad er nyt, og hvad betyder det for Danmark?

I henhold til den Nye FDI-Forordning skal alle medlemsstater indføre en FDI-screeningsmekanisme, der opfylder minimumskravene i artikel 4, stk. 4. Dette udgør et skridt i retning af større harmonisering i hele EU. Ikke desto mindre vil national sikkerhed fortsat være medlemsstaternes enekompetence som udtrykkeligt fastsat i TEU artikel 4, stk. 2, og underbygget af TEUF artikel 72 og 346.

Ny gruppefritagelsesforordning for statsstøtte sendt i offentlig høring

Europa-Kommissionen har den 25. februar 2026 sendt et udkast til en ny, forenklet gruppefritagelsesforordning for statsstøtte (kendt som "GBER" - General Block Exemption Regulation) i høring. Den offentlige høring løber frem til den 23. april 2026, og alle interesserede parter opfordres til at komme med bemærkninger. Revideringen af den generelle gruppefritagelsesforordning forventes vedtaget inden udgangen af 2026 med ikrafttræden den 1. januar 2027.
