Tennessee’s new law, effective July 1, 2026, will sharpen answers to these questions. Over the past few years, some states and the Federal Trade Commission have become increasingly skeptical about the enforceability of noncompetes. Tennessee’s new law doesn’t fully embrace that skepticism.

Southwest Airlines has spent the past year chipping away at the things that once set it apart. Free checked bags, open seating, and its famously flexible ticket policies have all been largely abandoned. In their place: assigned seats, new fees, and more tiered perks — part of a broader push to monetize the flying experience and boost revenue after struggling to turn a profit post-pandemic. It has been a tough pill to swallow for loyal Southwest flyers who long relied on its simplicity and freebies.
