Varnum secured a significant win on behalf of its client in a major Telephone Consumer Protection Act (TCPA) lawsuit, following a Report and Recommendation from the U.S. District Court for the District of Delaware denying the plaintiffs’ motion for class certification in Morales v. Sunpath Ltd. The lawsuit involved telemarketing calls promoting vehicle service contracts. Plaintiffs sought to certify three classes and several subclasses consisting of thousands of individuals.

Varnum LLP successfully represented Energy Michigan, a trade group for alternative energy suppliers, in challenging the Michigan Public Service Commission’s (MPSC) buy-local rule requiring energy providers to source a portion of their electricity locally. MPSC’s buy-local rule mandates that power providers in much of Michigan’s Lower Peninsula either purchase or produce at least 2.7% of their energy locally.

Varnum recently defended an apartment complex landlord in a housing discrimination matter in which the plaintiff alleged discrimination because of his physical disabilities. All claims were dismissed in U.S. District Court on a successful motion for summary judgment following discovery, and the dismissal was recently upheld by the U.S. Court of Appeals for the Sixth Circuit.
