Tricolor Situation Overview Tricolor Auto Acceptance, LLC (“Tricolor”), founded in 2007, is a “buy here-pay here” (“BHPH”) subprime auto finance company. This means that it is both an auto dealer and an auto finance company, offering in-house financing directly to its customers. Tricolor is also a Community Development Financial Institution (“CDFI”).1 Tricolor, which is a subsidiary of Tricolor Holdings LLC, operates over 60 dealerships, the majority of which are located in Texas and California.

On March 19, 2024, the Third Circuit handed down a decision that statutory trusts used as issuing entities for securitizations are considered “covered persons” for purposes of the Consumer Financial Protection Act ("CFPA"), in the long-running case involving the Consumer Financial Protection Bureau ("CFPB") and the National Collegiate Master Student Loan Trust ("NCSLT").
