Few in Bangladesh can have missed the footage of Abu Sayed’s shooting on July 16th 2024, outside Begum Rokeya University in Rangpur: a man standing with his arms outstretched, presenting no threat, shot at close range by two police officers. It was the first death of the protests, broadcast live and widely shared on social media — and it transformed the student demonstrations into a national cause. The footage would have justified prosecuting the two officers for murder, or at least manslaughter.

Au TSL, de tels procès étaient autorisés, mais soumis à des garanties. Premièrement, un accusé conservait le droit de mandater ses propres avocats depuis l’étranger.

To date, no modern international crimes tribunal – other than the former Special Tribunal for Lebanon (STL) – has permitted trials in absentia, without the accused present in court. At the STL, such trials were permitted, but subject to protections. First, an accused retained the right to instruct from abroad his or her own lawyers.
