On June 25, federal district court Judge Vince Chhabria ruled against a group of authors suing Meta for using their works without permission to train artificial intelligence (AI) tools. But Chhabria also gave voice to a concern that could prove critical in other copyright cases: that a “flood” of AI-enabled content may harm the market for existing creative works.

On May 1, a US court for the first time considered whether and under what circumstances developers’ use of in-copyright works to train AI models is consistent with “fair use” and copyright law. Kadrey v. Meta – in which a group of authors has joined together to sue Meta for, among other things, using their copyrighted works to train AI models without permission – is just one of many such hearings coming in the future.
