Congested southbound traffic on Interstate 15. (Photo by Thomas Murphy / Times of San Diego) Trucking companies do not usually line up behind tax increases. But in 2017, we made an exception. The California Trucking Association supported Senate Bill 1, the Road Repair and Accountability Act, even though it raised the diesel excise tax our members pay on every gallon.
Independent truckers are an integral part of our supply chain, and the industry has relied upon them since interstate trucking’s inception. The opportunities and flexibility of this arrangement give truckers the ability to control their own schedules, set their own routes, and run their own small businesses. It is disappointing, therefore, that this employment model chosen by 350,000 Americans has come under unprecedented attack at the state and federal levels.
The imminent imposition of AB 5 on the trucking industry triggered the recent shutdowns at California ports, including Oakland. AB5 codified the employee classification test under the landmark 2018 Dynamex decision. This change significantly narrows the circumstances for someone to qualify as an “independent contractor” and prohibits more than 70,000 drivers from continuing to earn a living under a model that has been allowed for decades.
Ephemeral streams, while appearing as simple drainage ditches, are one of many critical parts of our planet. A heathy natural ecosystem is made up of diverse, interconnected parts. Each part plays an important role to ensure that the rest of the system stays in balance and works as a united whole. A great analogy is an airplane. An airplane has many parts, some more critical than others, but each plays a role in ensuring that the plane can take off, fly and land safely.
