Download this insight (PDF) Last Friday, the Office of Information and Regulatory Affairs (OIRA) released its 2026  Unified Agenda and annual Regulatory Plan. The Regulatory Flexibility Act requires agencies to publish semiannually in the Federal Register a “regulatory flexibility agenda,” but the administration does not call this “spring” Agenda, and appears to have opted for a single one for the year.

The ANPRM specifically seeks information regarding the efficacy of the existing rule, as well as potential changes to the geographic scope, vessel size thresholds, and alternative enforcement mechanisms.

Managing Uncertainty in Benefit-Cost Analysis

Originally published in The Regulatory Review Since the Reagan Administration, agencies have used benefit-cost analysis to determine whether a proposed rule will yield net benefits for the public. This not only helps to determine whether to regulate, but also helps courts determine whether an agency considered all relevant factors or made errors in judgment.
