Introduction Mr. Zheng owned a strata lot within Strata Plan BCS 3426. The strata corporation charged Mr. Zheng $3,872.91 for emergency repairs to the strata lot below his that resulted from a water leak caused by a dysfunctional toilet wax seal. Mr. Zheng argued that he was not negligent in maintaining his strata lot and therefore that the charge was improperly imposed. The strata corporation maintained that he was responsible as the leak originated within his strata lot.
