In Short The Situation: On September 13, 2022, the United Arab Emirates ("UAE") Ministry of Justice ("MoJ") sent a letter to the Dubai courts stating that the MoJ considers the recent UK High Court decision in Lenkor Energy Trading, enforcing a UAE judgment, as having satisfied the element of reciprocity under UAE law when evaluating enforcement of English court judgments in the UAE.

Questions Remain as Supreme Court Restricts § 1782 Discovery in Private International Arbitrations | JD Supra

The Cases Before the Court In December 2021, the Supreme Court granted certiorari in two cases, which it consolidated, presenting the questions whether § 1782 could be invoked in aid of international commercial arbitrations or investor-state arbitrations. In ZF Automotive US, Inc. v. Luxshare, Ltd., a U.S. company and a Hong Kong company had agreed to resolve disputes in a private commercial arbitration in Germany. Before initiating arbitration, Luxshare sought § 1782 discovery from ZF.
