On May 26, 2026, Governor Kathy Hochul signed a law, included in the State budget bill, to amend the Climate Leadership and Community Protection Act (“CLCPA”), New York’s landmark statute requiring steep reductions in statewide greenhouse gas emissions (“GHG emissions”). This Client Alert summarizes the CLCPA amendment.

On May 26, 2026, Governor Kathy Hochul signed a law, included in the State budget bill, to amend the State Environmental Quality Review Act (“SEQRA”). The law is effective immediately, without any implementing regulations. As amended, SEQRA now contains new exemptions and new deadlines intended to speed the process. Housing Development Exemption A principal goal of the SEQRA amendments is to accelerate the construction of new housing.

In a much-anticipated order, on December 18, 2025,1 the Federal Energy Regulatory Commission ("FERC" or "the Commission") ruled that existing rules for service applicable to generators serving co-located load2 and customers taking transmission on behalf of such load are unjust and reasonable. The Commission directed PJM Interconnection LLC ("PJM") to adopt reforms designed to facilitate service to large loads.
