South Africa: Opening the door to competitive offshore sourced borrowing – interest rate caps on inward foreign loans removed

The South African Reserve Bank’s Financial Surveillance Department (FSD) has removed the interest rate cap for inward foreign loans and foreign trade finance facilities (together, foreign borrowings) extended to South African residents by non-residents. This change was first signalled in the Minister of Finance’s 2026 Budget Speech and is effective from 8 April 2026.

South Africa: Draft Protected Disclosures Bill, 2026 published for public comment

The Minister of Justice and Constitutional Development has released the draft Protected Disclosures Bill, 2026 (Bill) for public comment. The Bill arises from the findings of the Judicial Commission of Inquiry into Allegations of State Capture, Corruption and Fraud (Zondo Commission) which identified significant shortcomings in South Africa’s whistleblower protection framework. It proposes to repeal and replace the existing Protected Disclosures Act 26 of 2000 (PDA) in its entirety.

Mauritius: Competition Commission gains formal market inquiry powers

Recent amendments to the Competition Act 2007 (Act) have introduced formal market inquiry powers through a new section 51B. These amendments empower the Executive Director of the Competition Commission of Mauritius (CCM) to conduct broad-based examinations of market conditions across the economy, even in the absence of a suspected infringement.
