Courts Adopt Different Approaches in Implementing the Due Process Protections Act | JD Supra
In a December 2020 article, we highlighted in this blog the amendment of Federal Rule of Criminal Procedure 5(f) in the new Due Process Protections Act (“DPPA” or “the Act”). New Due Process Protection Act Amends Criminal Rule 5 to Strengthen Defendants’ Brady Rights
A new law will require all federal judges to enter an order at the beginning of every criminal case advising prosecutors of their duties under Brady v. Maryland, 373 U.S. 83 (1963) to disclose exculpatory evidence to the defense. Intentional violations of the orders could subject prosecutors to stern sanctions – up to and including vacating a conviction or disciplinary action against the prosecutor – or even contempt.
Hyper-partisan Gerrymandering and Separation of Powers Can’t Coexist
After 36 consecutive years of governing the great State of North Carolina, we have gained a perspective that few will ever experience. Although our policies and political viewpoints often differ, today we stand united on a matter that has critical importance to the constitutional democracy of our state. On Aug. 14, we joined together in filing an amici curiae brief in Wake County Superior Court in support of the plaintiffs in Common Cause v. Lewis.

That’s Awesome…Or Is It?
My kids learned early in life not to use the word awesome around me. One of my pet peeves was their frequent description that everything was “awesome.” They might use the adjective to describe skateboards, cars, motorcycles, purses, actors / actresses, singers, bands, vacations…you get the idea. English dictionaries describe awesome as causing or inducing awe, inspiring an overwhelming feeling of reverence, admiration, or fear.

EASLEY: What are your greatest challenges in the morning? When you wake up what comes into your mind? What comes into your head about the day? Is it staying in the marriage? Is it staying in the job? The fight at work? One of your kids that is breaking your heart? Is it a health issue? A financial issue? We all have them. Pain is the common denominator. Why We Believe What We Believe
INTRODUCTION: Justification is not “just as if I’d” never sinned. Never say that definition out loud around me. That’s a horrible definition of justification. Justification is the work of Jesus Christ to declare you righteous. EASLEY: I doubt any of us have been untouched by cancer. It seems we all have a friend, a family member, we know someone who’s battling cancer. When cancer strikes, it strikes our hearts with fear and before long we are looking at a myriad of traditional options.
