1. 공소사실의 요지 본 사건(대법원 2025. 1. 23. 선고 2022두2278 판결)에서 피고인은 2016. 12.경부터 2017. 7.경까지 중소기업청이 주관한 창업 인턴 지원 사업에 참여하면서, 실제로 인턴 직원으로 근무한 사실이 없는 자를 인턴 직원으로 채용한 것처럼 허위 등록한 다음 중소기업청에 지원금을 신청하여 창업 인턴 지원 사업비 11,613,680원(이하 ‘이 사건 인턴활동비’)을 지급받았습니다. 보조금 관리에 관한 법률(이하 ‘보조금법’) 제40조 제1호는 거짓 신청이나 그 밖의 부정한 방법으로 보조금을 교부 받은 자를 형사처벌하도록 규정하고 있는바, 검찰은 피고인을 보조금법 제40조 제1호 위반으로 기소하였습니다. 2. 사건의 쟁점 및 법원의 판단 본 사건에서는 피고인이 지급받은 이 사건 인턴활동비가 보조금에 해당하는지 여부가 문제되었습니다.
