Portugal’s Capitalisation of Companies Incentive (Incentivo à Capitalização de Empresas, or ICE), introduced by the 2023 State Budget, was implemented in the broader context of the discussions at EU level surrounding the proposed Debt-Equity Bias Reduction Allowance initiative. The regime promotes equity financing through a notional interest deduction.

Foi finalmente aprovada, em Conselho de Ministros a 28 de agosto, a proposta de lei que cria o regime de grupos de IVA em Portugal. Trata-se de uma medida há muito aguardada pelas empresas, prevista no programa “Acelerar a Economia 2024”, e que visa aliviar a tesouraria dos grupos empresariais através da consolidação do IVA a pagar ou a recuperar entre várias entidades do mesmo grupo. A decisão marca um passo relevante na modernização do sistema fiscal português.

In a decision dated July 19 2023, within the scope of Case C-335/22, the Court of Justice of the European Union (CJEU) ruled that the Portuguese stamp tax on fees for placing debt securities (such as bonds and commercial paper) on the market is contrary to Council Directive 2008/7/EC of February 12 2008, concerning indirect taxes levied on the raising of capital (the Capital Raising Directive).
