USA July 8 2024 On June 28, 2024, the Consumer Financial Protection Bureau (“CFPB”) published a blog post warning lenders to comply with provisions of the Home Mortgage Disclosure Act (“HMDA”) or be held accountable. The CFPB is particularly concerned with lenders’ failure to collect borrowers’ demographic information at the time of origination of the loans.

The CFPB Moves on its Inquiry Into Increased Mortgage Closing Costs

The Consumer Financial Protection Bureau (“CFPB”) is seeking comments from the public, particularly consumers and lenders, to assess the reasons for increases in mortgage closing costs. Alleged junk fees are cited as part of the cause of increased closing costs, which surged by 36% from 2021 to 2023. The CFPB states that many of those costs come from third party charges, such as for title insurance and credit reports.

The Foreclosure Abuse Prevention Act is Now Law | JD Supra

On December 30, 2022, New York Governor Kathy Hochul signed into law the Foreclosure Abuse Prevention Act (FAPA) after the bill’s passage by both the New York state senate and the assembly. FAPA is a direct response to a New York Court of Appeals decision, Freedom Mortg. Corp. v Engel, 37 N.Y.3d 1, reargument denied, 37 N.Y.3d 926 (2021) that seemingly gave lenders the right to unilaterally restart foreclosures and avoid a statute of limitations bar.
