Biosecurity management plans: free pass for resource companies

A recent decision of the Queensland Supreme Court has identified a serious deficiency in the State’s biosecurity legislation – that resource tenement holders do not have to comply with landholder’s “biosecurity management plan” (BMP). The case In Lang v Westside Corporation Pty Ltd, the Lang family sought an injunction in the Supreme Court to restrain Westside Corporation Pty Ltd (Westside) from accessing the Lang family’s property until it agreed to comply with Lang’s BMP.

Reforms opens up pastoral land to renewable energy development

For example, holders of a term lease for pastoral purposes can now apply to add a renewable energy purpose to allow for the development of a project. Such leases could not previously be changed to allow purposes other than grazing or agriculture, ruling out renewable energy projects. However, the change does not extend to certain leases under the Forestry Act 1959 and Nature Conservation Act 1992 (such as State forests and timber reserves).

Overhaul to Queensland's property laws

The greatest impact on the property market will likely come from the new seller disclosure requirements. Sellers will now be required to provide purchasers with a disclosure statement and certain “prescribed certificates” (such as a title search, rates notice and registered survey plan) before a contract is signed. Buyers will be entitled to terminate the contract any time before settlement if a seller fails to provide the requisite disclosure or if the disclosure contains inaccuracies.
