The High Court has today held that the decision to proscribe the direct-action group Palestine Action under terrorism powers is unlawful. The Court found that the Home Secretary failed to comply with her own policy when making the decision to proscribe Palestine Action and that proscription breached the rights of freedom of expression, assembly and association protected by Articles 10 and 11 of the European Convention on Human Rights.

Huda Ammori, co-founder of Palestine Action, has been granted permission by the High Court to challenge the Home Secretary’s decision to proscribe the group under anti-terrorism legislation. Mr Justice Chamberlain ruled in favour of Ms Ammori on an alternative remedy argument advanced by the Secretary of State, and granted permission for the claim to proceed on human rights and procedural fairness grounds. The Judge refused the Home Secretary permission to appeal to the Court of Appeal.
