Life in the Fast Lane: USPTO Waives Petition Fee for Expediated Examination

With some additional limitations, the United States Patent and Trademark Office (USPTO) is allowing expedited examination by waiving the petition fee for the Streamlined Claim Set Pilot Program. In October 2025, the USPTO launched the Pilot to grant special (expediated) status to pending utility applications that meet the eligibility requirements outlined below. The Pilot launched with a modest petition fee of $150.

Beyond the Display: New USPTO Guidance Opens Design Patent Coverage for Virtual, AR, and Projected GUIs

On March 13, 2026, the U.S. Patent and Trademark Office (USPTO) published Supplemental Guidance for Examination of Design Patent Applications Related to Computer Generated Interfaces and Icons confirming that interfaces in newer digital design formats such as projected, virtual, and augmented reality are patent eligible. In addition, The Guidance increases the flexibility in titles and claims for designs directed to interfaces and removes the requirement to depict a display in the drawings.

As a matter of best practices, patent practitioners draft claims of various types to protect inventions from multiple angles and to improve the chances of reaching allowable claims. Sometimes, this includes drafting claims with negative limitations. In addition to multiple claim types, practitioners argue secondary considerations of non-obviousness to reach allowance. Both strategies can be useful to reach allowable subject matter in difficult cases.
