Failure to properly diagnose or treat a patient constitutes medical malpractice. Failing to obtain informed consent is one example of this. Neglecting a patient under anesthesia is also a form of medical malpractice. Malpractice symptoms include skipping vital parts of the examination or only doing the most superficial exams. Furthermore, the patient's condition may not be a good fit for the therapy. Failure to diagnose is one of the most common types of medical malpractice.

Other examples of failing to treat a patient include doing so while they are unconscious. Failure to finish an examination or relying solely on a few simple diagnostic tests are examples of malpractice. The treatment may not be suitable for the patient’s condition.
