USCIS plans to abolish 60-day grace period for certain nonimmigrant workers | JD Supra
The proposal was published Friday, and comments are now being accepted. On Friday, the U.S. Citizenship and Immigration Services published a Notice of Proposed Rulemaking that, if adopted, would eliminate the 60-day grace period currently granted to most nonimmigrant workers in H-1B, H-1B1, E-1, E-2, E-3, L-1, O-1, or TN status who abruptly lose their positions.

On Friday, the U.S. Citizenship and Immigration Services published a Notice of Proposed Rulemaking that, if adopted, would eliminate the 60-day grace period currently granted to most nonimmigrant workers in H-1B, H-1B1, E-1, E-2, E-3, L-1, O-1, or TN status who abruptly lose their positions. The grace period has been in place since 2017 and allows nonimmigrants who lose their jobs to look for other positions in the United States or to conclude their affairs.

On October 17, 2017, a federal judge in Hawaii partially blocked the third iteration of the Trump administration’s travel ban. U.S. District Judge Derrick K.
